Condo Conversion, Certificate of Occupancy
Hello, I’m interested in a unit in 509 Chanucey but when I checked the DOB I noticed there is no CofO. I spoke to the broker and he told me since it’s a conversion the building does not need one. Is this correct?

Buildings built before 1938 don’t need a certificate of occupancy (that’s when the requirement was enacted). If the building was built before 1938 and has no c of o, the only reason one would need to acquire one is if there is a change of occupancy (say, you have a 2 family house and you want to convert it to a 3 family house). If you look on DoB under permits for this property and look at the most recent permit, it says “NO CHANGE IN OCCUPANCY, EGRESS, OR USE.”, hence they had no reason to acquire a certificate of occupancy. Btw, I went to see 509 Chauncey – really cute! We decided on buying a house rather than an apartment, though. You might also want to look at the 568 Willoughby building – also very nice.
