Peeling lead paint violation - how to fix safely?

There is a some misinformation here. Current HPD and DoH lead violations can be ONLY be corrected by an abatement company not an RRP renovator. Exceptions are old HPD lead violations issued before local law 1 where, in some cases, you may be able to self-certify and submit dust wipes and DoH violations where it is an owner occupied unit. Additionally, while HPD violations allow for paint repair by an abatement company all DOH orders require full abatement (e.g. installing drywall over the wall as opposed to wet scrape and paint.

I have an old violation from 2001 (way before I bought the building) for peeling/cracking lead paint in one of the tenants’ bedrooms.  It’s just two sections a few square feet in size on a plaster ceiling.  The apartment has no kids FYI since I know kids are much more at risk with this sort of thing.  The tenants have also never mentioned anything about it- I only knew of it because it came up on the ECB violation search online. What’s the best way to handle this? I’ve heard you want to avoid scraping it an then repainting it because that’ll get the lead dust everywhere. My friend said what they usually do is just put a new drywall ceiling over the plaster ceiling to encapsulate it. Any advice on how to proceed?  Anyone have to deal with an issue like this before who can share their solution?

Putting in a drywall ceiling seems a bit extreme.  I’m going through something similar and unfortunately it came about because our baby tested for EBLL (elevated blood lead levels) so it’s pretty scary stuff.  From the research I’ve done the best method to quickly stop peeling lead paint is to simply paint over it, however you can repair the plaster if you employ a HEPA vacuum at the site of any scraping or sanding.  You can buy HEPA filters for standard shop-vac’s FYI.

Best way is to get a Lead Abatement company to inspect the violating areas and provide you with a detailed analysis as to what the results are so you can remediate.  You will then submit that proof of remedy along with the analysis to the issuing agency in order to remove the violation.

This all seems a little extreme. Get a contractor or professional painter who has been trained in lead abatement practices. They’re required to be now by law. I doubt they’ll cover the ceiling with drywall. More likely they’ll tent the area and scrape while vacuuming, then plaster and paint over it.

Just hire an EPA certified lead safe renovator/painter to clean up and paint the area. It’s not really that big of a deal, just more prep and clean-up work. You don’t need a lead abatement company, they will charge you thousands to remove lead that you don’t need to have removed. Only the areas where the paint is disturbed need to be dealt with. As far as dealing with the violation… I’ve never had to file for that so it is possible you’ll need a professional lead testing company to certify there is no lead paint or dust present in the apartment. This is different from a certified renovator who is only certified to work safely around lead paint.
