I also want to thank those who post recs for good companies. I’ve got a similar issue in my basement. What I was told was that you have to hire a NY licensed company but also an air monitoring firm (cost about $700 per day) for each day they do the removal (usually 2-3 days). Its considered a conflict of interest for the Abatement company to hire the air monitoring firm though they usually recommend one to the buyer. I’ve been doing a lot of research on this issue if anyone wants to hit me up with an email.  As for your case, that’s terrible. The issue will probably come down to how much you “should have known” about the said violation and how much you can shift the burden to the abatement company. Hard to say without more details but good luck and please let us know how it goes.

hi , i have just recieved 17,500 dollars of fines and have a hearing with the ecb ,can someone tell me about  similar experience and any success dealing with . i bought a brownstone , hired a licensed company to remove the asbestos , the d e a came shortly after teh company did , shut them down , then allowed them to proceed after some changes , they told me i would not be fined but now i have recieved an offer to pay 17,500 dollars of fines for 7 violations max penalty 10k per violation  , the company has also been fined – an offer of 31 k , any advice ??!

OP and eme, can you please elaborate? I might have to deal with a similar situation soon, and I was under the impression that there is no risk in dealing with this sort of thing “properly” by having professionals come and remove the asbestos. But if there’s a risk of tens of thousands of dollars in fines when doing it in this way, then I have a different decision to make. Please explain… thanks!

How do yo uknow they were licensed? Did they file for permits? Did you get an ACP-7 and/or ACP-5? What are the violations for? That’s like saying “I hired a LICENSED contractor but the DOB fined me because I didn’t have permits.” Need to know more…
