Newly Developed Condo w Construction Problems

We bought a condo last May in a gut-renovated brownstone.  There have been ongoing venting and water issues in the building.  Mostly in our apt which is the bottom duplex.  The sponsor is still under warranty, and has sent countless people over to find the source of the problems and offer solutions, but so far, no work has been done.   It seems more and more as if he is stalling.  The building is in the process of finding a PE.  I am ready to consult a lawyer. Any advice or similar situations?   Any recommendations for a good litigating real estate attorney?

I currently manage 3 new condo buildings that are suing the sponsor for Construction Defects, mostly related to the roof and pointing issues, some with more success than others. Slopemope is right about the AG, however the attorney general’s office will take years to get anything done so start the process as soon as possible, like today, right now.  I would not let the sponsor’s workers go anywhere near the problem, they already proved they can’t build it right which means they probably can’t fix it right. You might try hiring a good roofer to investigate the water issues and a good plumber for the venting issues. Then you can compel the sponsor to fix the problems. Sometimes the source of problems can be elusive. Three engineers were wrong about what was causing water problems in our basement. A roofer figured it out by running a hose. Plumbers have also been able to pinpoint the source of some of our venting issues but not all.

“ongoing venting and water issues”   can you elaborate?  why would you need a PE?  i’m guessing none of you have ever owned a home.    anyway, before you litigate, call the attorney generals office.  that is your free “kick in the arse” to the sponsor.  they are used to handling these things, so make sure your communication back and forth with the sponsor is well documented.     Before you get emotional, get your own opinions and estimates.  Right now it sounds like you don’t know what is wrong, nor what it would cost to fix.  I’m not sure what paying someone $400 or $500 an hour is going to do for you on that.      i’m guessing you’re frustrated, but honestly you should be able to figure out what is going on before going broke on an attorney.  Don’t rely on the sponsor – obviously they are sending out the same kind of people they hired to do the work in the first place, like a circle of incompetence.     good luck,
