looking for sample contract for hiring an architect/contractor
The AIA contract does favor the architect. It can be made fair by use of a rider to strike or amend language.

Does anyone have or know where to find a sample contract to use when engaging an architect and contractor? I want to protect myself as I embark on a construction project. Thank you in advance for your thoughts.

All other contracts are more protective of the service provider and less protective of the consumer. I am licensed by the NYC Dept of Consumer Affairs (DCA) as a Home Improvement Contractor (HIC), and I include this language in my contract as required by law. Contracts other than this one are used by contractors who don’t follow the law. Please understand the requirements of the law are expensive. Protecting you from higher costs is not part of the law. A law abiding business not only meets contractual terms, but also pays taxes on payroll and provides workers compensation insurance on payroll – we are even required to insure workers for un-insured subcontractors. A multi-trade, licensed, small HIC like my firm pays 40% more for payroll than one who avoids taxes and insurance. Do you want to protect yourself from high prices, or do you want a binding contract? Angie doesn’t work for the DCA, but you already pay taxes, and I pay in to a fund which you can draw on, if your contractor ditches you. Other than funding government and protecting workers, HIC’s offer a pretty good deal for the consumer, in terms of ethical reliability. Skills, training, experience, and code compliance are not part of the DCA license test. Architects have their own contracts or use ones from the AIA. The DCA contract is not required for commercial work. Many HIC’s, who are in favor of consumer protection, feel the DOB would do a better job than the DCA. Workers Comp is regulated by the State. Apparently, the NYS Assembly Insurance Committee (25 elected representatives seeking campaign contributions) is dedicated against home owners and in favor of new construction. My high insurance rate subsidizes large public projects, Atlantic Yards, and the smaller Condo developments in your neighborhood. The insurance rate for specialized, often-injured workers, like those who wear hard hats, is about half of what it is for multi-trade workers in safer conditions, like the ones who renovate your kitchen or bathroom. The AIA contract protects the architect, not the customer. Having used one once I will never use it again.
