Evicting tenants
The fact that there are children in the apt will hinder an eviction—however, in my opinion, you should proceed with same. It will take time.

The building is a legal four family and they have no lease. They are a husband and wife with two kids. I bought the place a few months ago (should have had them evicated beforehand but it is what it is) and they have been a pain in the neck since they one… Late payments, dirty, false complaints to avoid rent, and so on. I decided to evict them and served them a 30 day notice (took a lawyer who handled it so there is no chance of not serving them correctly). I spoke with several lawyers before starting this and they all said that it is a question of time and not of IF they will be evicated. I heared that it could take anywhere from 2-6 months but that they will need to pay rent during this time if it does take this long. Is this true? Also, should I prepare a “case” to present to the judge against them (I actually have a lot)? I was told that it won’t speed things up as they basically can’t really ask to stay but they can only ask for extensions and regardless of what avidance I bring, they should be granted those extensions at least for a few months. Is this true? Any advice from people with experience in evications? it’s my first.

Depending on the case, court and Judge, it might even take months until the Judge takes a look at it. If you get rent during that time – congratulations. They are a family, try to make a deal.

you are looking at a year or two of no rent being paid if they claim harrassment by you…if you are lucky they will put rent in escrow, but i had a client in Manhattan that took 4 years to work through the system

not sure what you guys are basing this on…. this excerpt is from the NYC courts.gov landlord booklet: “In a holdover case, you are not required to give up any payment that the tenant will owe for
the months that they live in your apartment. The maximum amount of time a tenant can stay
in an apartment where they have no legal right to stay (i.e., in a non-rent stabilized or rent
controlled apartment where there is no lease or the lease has expired) is six months.” Mine is a holdover case, it is without a lease and there is no rent stabilazation. If the maximum is 6 months then probably a lot leave sooner. Which is what all my lawyers said….

Of COURSE your lawyers told you 2-6 months (sometimes true, sometimes not). Of COURSE your lawyers told you they served them correctly (sometimes true, sometimes not). If your lawyers told you that rent can be collected after tenants have been served in a HOLDOVER case (never, ever), find yourself another lawyer (true without exception). Once you serve holdover tenants, you can’t collect a dime UNLESS and UNTIL you win your case (sometimes you’ll win, and sometimes you won’t).

Look at what tenant.net has to say about holdover cases: ” If your landlord does not accept rent after the 30 day period covered by the 30 Day Notice — save this rent money. You will be required to pay this at some other point. If your landlord accepts your rent … you should notify the Housing Court judge. This may be grounds for dismissing the landlord’s case.” http://www.tenant.net/Court/Howcourt/holdover.html No personal experience with evictions – some tenants may cooperate and move; others may drag it out in court and a professional tenant can give you grief for a lot more than 6 months. If you can work something out with the tenant that avoids going to court you’re probably much better off.
