tenants

we have a tenant with a yappy dog. he has had it for some time but now it yaps all night and its a problem. He also does not walk the dog wee pads but ofcourse he always has accident. Can I ask the dog to leave? My neighbors are ready to call the asap since the dog is kept in one room and not brushed. any help is appreciated. he is rent control

For goodness sake, we have a “yappy” dog next door to us.  Said dog is also a very good dog who, I reckon, also provides protection for the block with her “yappiness”. She only “yaps” when her entire family may not be home and then the “yapping” ends once the family returns. I have never, ever, thought to call the ASPCA or 311 on my neighbor’s dog, that would be a terrible thing to do. Do you really really think that this dog is being mistreated?  If you sincerely think that, then, you should take action.  Otherwise, you should not do same.  It might be a harder road to take but perhaps you might forget about your own issues (yapping dog blues) and perhaps you might befriend this dog and his owner Life isn’t easy in the big city.  It ain’t McMansions here.

NO he is rent controlled but he is early 50’s he has a girlfriend and his kids live with the Mom. The dog is actually his daughters not his. Look as a dog owner of 20+ years i am not thrilled by any of this. But keeping a dog inside sh***ing and pissing and not bathed or exercised…..is just wrong.

You should talk to the dog owner. Express your concern for the dog, don’t just tell them it’s annoying. Maybe the dog only starting yapping recently because they changed jobs and haven’t been home enough. A dog walker would be the best scenario if you could get them to do that.

Ok because as in most cases its not the dog its the owner to keep a dog in one room and never take him out. As a dog owner it is just inhumane.

There are two different agencies.   ASPCA is a non-profit shelter.  If they confiscate the dog, they will rehome it, not kill it. NYACC is a city pound.  If they confiscate it, they will keep it as long as they can (probably less than a week) to try to rehome it.  If they don’t find a home, they will euthanize it.

if the dog is kept inside the aspca i think is usually reluctant to take an animal away. they are more likely to do so if its a dog chained up outside with a crappy doghouse all winter. calling them isn’t a bad idea, it might get the person to change their behavior. I hope you or someone has tried talking to them first. It can be akward but I find can work better then going right to the city to to try to remedy it.

if that dog has been there longer than 3 or 6 months, I don’t remember the law exactly, no, you can’t do shit except call 311 to complain. after the city comes out and verifies, they can start to get fines for noise/nuisnace but you can’t evict or force them to give up the dog especially if the lease doesn’t preclude it.
