Rent Refund for Early Move-out at LL's Request?
We paid our final month in full but hustled to move out a week early in order to accommodate our Landlord’s requests. We got our deposit back, but would we be entitled to a refund for those prorated days? Nothing in writing, unfortunately. (FWIW, when we moved in, he let us come in a few days early but charged us for those days.)

I know I wouldn’t be able to let it go – it would rankle for a long time. I’d give the threat of small claims court a try. I agree, though, that piling on other things that probably should’ve been dealt with when they happened will weaken your position.

Unfortunately, you should have put your request in writing and had him agree to it in writing when you agreed to move out a week early. At least you got your security deposit back. Could it be that he thinks there was some damage to the apartment and in his mind you were not entitled to the full security? I don’t know. But it is one week’s rent, not a full month. I agree with PutnamDenizen. Cut your losses and move on.

Well, if he refused you once and then did not reply to a follow-up email, he’s likely not going to respond to a friendly appeal to common decency. You might try approaching with a threat: “Look, both you and I know that I vacated the apartment a week early at your request. And that you owe me the week’s rent. I am prepared to take legal action, as well as to put your name out there as a shady landlord —- I’m prepared to do so but I’d rather not go through all this nonsense. Instead, please refund me the rental money….” Or something like that. Good luck!

Most of what you propose to do works better prospectively rather than retrospectively. Once you are out of the apartment he’s gotten what he wanted. Given your list of grievances it sounds like you are well out of these. Throwing in unrelated claims (personal injury, property damage and the rent issue) actual undercuts the reasonableness of your claim. Might you not be better off moving on emotionally as you have already physically?

I know – putting me in the position is really d-cky of him. I wrote to him once asking for the money and he refused. I responded to his refusal and asked again but he just ignored me. I am such a chickensh#t about confrontation but this just burns my keister so much that I know I have to keep at it. Having community backup like y’all really helps with the ol’ backbone-growin’. I will definitely report back the guy’s name and, if he has already rented the place (not sure) tthen I am going to drop a note to the new tenants to warn them about him. There is plenty to warn them about. When I do hit the LL up again and , assuming he again ether refuses or ignores me, what I think I will do is let him know that I am not only going to go to small claims court but, since he won’tdo the right thing, I am going to ask him to pay for damages to belongings as well as physical injuries sustained while in his condo that he refused to maintain properly. I think that the decent thing to do would be for the landlord to have given you a refund of one week’s rent when he gave you back your deposit. More than that, since he requested that you move out early, he owes it to you. You should not have to ask for it….But it looks like he’s putting you in the position to do so. If he says “no” I guess there isn’t much you can do, except maybe to say who he is in this forum as a way to warm future potential tenants.

Since he charged you for a few days extra, the only right thing would be to pay you for the days you left early. Simply ask him reminding him of this fact. Don’t know if you are legally “entitled”.
