NYC lease (non)renewal...required notice?
I have a one-year lease that will expire on August 31, 2011\. On August 1, 2011, I asked my landlady if I could go month-to-month starting September 1 and she approved. She wrote me a letter stating that I would be month-to-month at the same rent from Sept.1 – Dec. 31, 2011, then month-to-month at $100 per month more thereafter.
Today, August 10, 2011, I returned home and had a note saying nothing more than “You need to see me about September 1 occupancy.” My fear is that she has changed her mind about the month-to-month agreement and that she is going to tell me I have to be out by Sept. 1, 2011\.
So here is my question: Are landlords required to give a certain amount of notice if they choose not to renew your lease? I know the NYC rental market moves quickly, but three weeks’ notice seems very unfair, esp. given that she agreed in writing to allow me to go month-to-month.
Just being cautious…and would appreciate any thoughts on this. Thanks!

but of course frank f that would be immoral and wrong you freely contracted to risk only a months notice to only be liable to give a months notice a deals a deal and if she is giving you less than a month insist on a month or negotiate. and frank perhaps you could get a job as an obama czar of some sort but beware its definitely going to be month to month

you now are a month to month tenant. She can give you notice to leave but no earlier than October 1\. In NY she isn’t entitled to self help. It will take her 6 months to get you out(IMO)…

Your apartment is not rent regulated, correct?
Here’s a link to a page on tenant.net regarding Month-to-Month Tenants in NY that says “In New York City, the landlord must serve the tenant with a written termination giving 30 days notice which must state that the landlord elects to terminate the tenancy…
… For example, if the rent is due on the first of each month, the landlord must serve notice by August 1st that he wants the tenant to move out by August 31st. (Real Property Law ??232-a) ”

why think the worst of the situation? This might not be the case. She just might want to discuss options. If this isn’t the case, she has to give you a month’s notice which means any changes don’t kick in until October. October is not the best of times for an owner to market an apartment and if the stock market keeps on the path it is on, this October may not be very good for her.
