Notice by Tenants for Lease Non-Renewal?
I’ve read and re-read my current lease and I don’t see any language regarding tenant giving landlord notice for lease renewal or non-renewal at end of term (in an old lease, my other landlord requested 45 days notice). That she has to give us 30 days notice is not in the lease either, but (as I understand it) she legally has to do this in NYC. Am I missing something – do tenants not have to give at least 30 days notice as well?

“The writer does not specify if her apartment is rent-regulated or not, and that makes a difference,” said Sherwin Belkin, a Manhattan lawyer who represents property owners. If the apartment is rent-stabilized, he said, the owner is obliged to offer a renewal lease 90 to 150 days before the lease expires, and the tenant must accept or reject the offer within 60 days. “If the tenant fails to do anything,” he said, “this is tantamount to the tenant advising that she is leaving at the end of the lease.” If the tenant is not rent-regulated, Mr. Belkin said, unless there is some provision in the lease that creates an automatic renewal notice, the tenant’s only obligation is to vacate when the lease ends.

Here is how the HPD’s guide to tenant rights puts it (http://www.housingnyc.com/html/resources/attygenguide.html): “A month-to-month tenancy outside New York City may be terminated by either party by giving at least one month’s notice before the expiration of the tenancy. For example, if the landlord wants the tenant to move out by November 1 and the rent is due on the first of each month, the landlord must give notice by September 30\. In New York City, 30 days’ notice is required, rather than one month.”

Sounds like a sloppy lease. Just thinking out load (a dangerous thing). The landlord is not obligated to give you a renewal or tell you she wants you out. If you remain beyond the term of your lease she can move to evict you as an illegal holdover or, if she accepts your rent check, you become a month to month renter. If you want your landlord to apply a “last month’s rent” which she may be holding, you would, by becessity, have to give her notice of that, no? If she doesn’t have that, but only has your security deposit, I guess you could simply move out on the 31st and ask for your deposit back. Seems like she might get irritated and (illegally) try to stiff you on it. Maybe your question would be clearer if you stated what your goal was.
