Lease non renewal

Hello all, A quick question. I own a 3 family in BedStuy. At the end of one of my tenant’s lease, I would like to NOT renew the lease. I searched online and read that I only need to give 30 days notice of non renewal. Is this correct? Or are the actual terms (length of tenancy described in the lease) enough and I don’t have to give the person any notice? (Of course, I would like to give them time to search for an apartment) Should notice be given via mail with my signature? Certified mail? Do I also need to communicate this directly in person? Any advice would be most appreciated

I have tenants and I have forgotten to supply them with a lease, but will do so soon since one was due at beg. of July. Of course, they probably know it is a month to month situation, with each party being obliged to give 30 days’ notice, written in prior lease. I would certainly email and tell them verbally about the non-renewal of their lease if that was the situation. In my case, I would likely give them 2 months, but that is because I know and trust them. So much that I don’t charge them a security deposit. But we will see if under a circumstance where I need to terminate lease and have them leave, what they will do. No good deed goes unpunished for most of the time. Quite sure that madstuy is just inquiring about his stance on this. Plus, it’s his business with regard to any “story” behind the inquiry.

What does your lease say? Typically if you do nothing, the tenant becomes a month to month tenant. If you wish to end the tenancy, the decent thing to do would be to tell them so verbally as soon as possible, then send them written notice 30 days before the beginning of the first of the month (or whenever their rent is due). Normally you could just mail it, but if you anticipate any issues, for legal reasons, send it certified mail so you have proof it was sent.

If you have a decent relationship with your tenant, I would strongly encourage you to actually have a conversation with him or her first. Sending a certified letter out of the blue is not a warm and friendly message. It is, however, an excellent way to turn a good relationship sour. I had a good relationship with a landlord years ago. He decided at the end of a two year lease that he wanted to sell the apartment. Some lawyer gave him the advice that the best way to notify me was to have the lawyer send a certified letter. When I called him after schlepping to the post office to sign for the letter, he was apologetic and blamed his friend the lawyer. Nevertheless, I immediately started communicating with him only in writing, demanded receipts for returned keys, etc. Everything was copied to his attorney, which probably cost him legal fees for absolutely no reason. All of that could have been avoided if he had just dropped me an email or made a call to say that he wanted to sell the apartment.

Good luck with that attitude! How is a tenant supposed to know that they need to move with no notice? Crazy. And no, the tenant is not supposed to know they have to move because you didn’t send them a renewal lease. Many landlords continue on month-to-month after the end of a lease. Is a tenant supposed to be able to read your mind? Even when a new lease was given me (I always had a lease when I rented, never was month to month), often the landlord didn’t get around to sending it on time. I think they would have been quite unpleasantly surprised if I just up and moved out as a result of not receiving a renewal lease at least 30 days in advance! Since you don’t mention why you want them to move out, I think there must be more to this story.

Typically the end of a lease for a non stabilized unit, there is no automatic renewal so the tenant should know they have to move as no renewal was given. But to make sure everyone is on the same page, send a letter stating no renewal of lease and they must move by end of lease date. In all correspondence with tenants, certified letter is best so there is a paper trail.
