Landlord : Who should pay Con Edison

I own a 3 unit Brownstone. When tenants move out and the light is still on should I be responsible for the bill afterwards? Con Ed switch bill over to my name even though the apartment is now rented with a new tenant. It is accruing interest and going up. What should I do?

Maybe make an appointment with NG to have the meter locked at a future day (eg 7 days) and let the tenant know that you’ve been billed b/c they didn’t turn it on and that if they would like to continue the service (what does it run–stove, water heater?, let them know), they have 7 days to switch it to their name or the utility company will be turning it off. No need to be mean when telling them, but just conveying the facts and you wanted to give them time to take care of it should they want to have gas. It’s sad, but I know some seemingly together adults who rent and could very well be that clueless about such things–that they needed to put it in their name or even which appliances use gas vs electric.

Thank you all for your input so far. Here is an update: Nat’l Grid claims since 2010 no one turned gas on in their name (so defaulted to me in Sept 2015). This seems highly impossible since I’ve had 2 set of tenants in the APT before the current one. Another thing that’s strange the bill is only up to $300. Here is what I’m thinking to do since my current tenant obviously did not take initiative to turn gas on: 1\. Tell Nat’l grid to take my name off bill and lock meter 2\. Or play daddy to tenant and say you’ve been living here for 8mths and did not turn gas on in your name. please call Nat’l grid. Side note: Lease states utilities are not included. which option is best?

@cityrock, sure, call them and give them your tenants information. say that you are not responsible for the bill and you are not sure how you become the account holder in the first place.

@cityrock, con ed eats it. similar situation with nat’l grid. if a gas account has not been established or if the tenant racks up a bill, they will take you to court/send the marshall for access to remove the meter. but you still wouldn’t be responsible for the bill.

It sounds like your last tenant either did not open an account or they did not pay for the last few months. Con Ed is a bit slow at communicating these days and finds it easier to try to make the landlord responsible. Or at least try to collect from the landlords security deposit. Always pick up those letters from Con Ed addressed to Current Resident of Apt # ….. This is an indicator that the tenant has not opened the account. I have one rent stabilized building where this seemed to happen a lot. I now ask the tenant that is moving out to send me a copy of their last PAID Con Ed & National Grid bills, just to make sure that they have been paid, or else yes, you the landlord gets to pay the bill. If the apartment was vacant for a while between tenants, during a renovation etc. Yes you are responsible for the bill.

Our last tenant moved out in middle of the month and closed their account with Con Ed. New tenants started the following month. We had the account switched to our name in the interim (when we also painted, replace appliances, and did other repairs). In that situation ConEd charges you commecial tarifs which are higher than residential ones. Still the whole bill came to just $35 on a 1300 square foot apartment, so no big deal.

No Permits, I supposed I should have specified “non typical”, although it’s typical for us to refresh the apartment between tenants as they usually stay a few years. Every now and then, there’s a lapse in between tenants when we have to paint and do floors. Who pays for that time? Us. If one tenant moves out and the next one moves in the following day, then it shouldn’t be on the landlord at all.

sometimes con ed will send the owner a request for the tenants information if they have not established an account. when that happens, i sent con ed all of their information (ss #, lease, application) and also notify the tenant that they must establish an account from their lease effective date to avoid service disruption.

@no-permits, This is what I was thinking why would it automatically default to my name. I did not reach out to them as of yet. Don’t want to incriminate myself in process. Figuring eventually I will need to call. I am just thinking the new tenant did not turn on light in their name? But they have been there for more than 6 months already.

Not sure I understand the question. The new tenant should be on the bill now and the old tenant should have stopped service once they moved out. You pay for the time it was vacant. If anyone is not doing the right thing, you need to tell them to do so or take it up with Con Ed.

con ed normally doesn’t revert an account to the owner unless you put in an application for service. are you sure the account was reverted back to your name?
