Landlord forcing us to move out early because of "scheduling"

Hi everyone, My landlord only likes to let one person move in or out of a building per day and requires us to “schedule” moving sessions (a bit ridiculous since this is a building with nearly 80 units). I wanted to schedule moving out for the end of the month 6/30 because my lease begins 7/1\. Apparently multiple days of that week have been “called for” and I would have to move out much earlier. So I suppose my landlord expects me to pay for storage and a hotel for several days even though I am paying for the full month. Is this legal? What is my recourse? If I just don’t listen and schedule movers for 6/30 can he withhold my security deposit or forbid them from entering?

If it is written in the leases or riders anywhere in the lease about the move in – move out schedule…. You should have read your lease. If it is not written anywhere, and double check. Then just send notice of your move out schedule, make sure you are out and broom swept clean by the end of business June 30th and carry on. If you keep your records and notices as well as photos of the apartment as you leave it, you should get your security deposit back, even if it means going to small claims court. If they try to stop you moving out, just call the Police. Just try to move out without holding up the elevators, be considerate of other residents in the building etc and move out with as little disturbance as possible. The reason for scheduling move-ins and move-outs is because moving companies tend to take over the elevators, entrances and hallways, to the detriment of others in the building, blocking fire escape and emergency access etc. Basically causing Fire Department, Buildings Department and Insurance company night mares. With 80 apartments in your building, I am sue you are not the only tenants turning over, trying to move in & out at the same time.

If there are such specifics, it should be in your lease or a possible extra document of building rules that you would have signed when signing the lease. We almost took such a rental in such a co-op building and the move rules were crazy. When we went to sign the lease on such a building once we found this out (and it was going to mean almost a 2 week gap between leases (and there were a few other rules that prohibited things we had specifically been told were allowed)–we ended up walking away from that one.

Though you have the right to stay until the end of the month, most building above a certain size have strict rules about moving in and out so not sure what you can do. I would have scheduled much further in advance than this for a June 30 moving date assuming you knew this policy.

have you paid rent for this month yet? this sounds dubious. is there any mention of it in your lease?
