Landlord and tenant issue

We went to hand out a move-out letter to the tenant tonight, but the hubby was not at home, the wife and two teens did, I told the son to tell his stepfather to call us. After half hour, his stepfather sent messages to my hubby saying ME intended to attract his son, and he is going to court. I even didn’t enter the apartment and touch his son. I’m terrifying, what can I do?

Please take my advice. I’ve gone/going through this. Lucky for you that you do not live in the same compound I do. After telling tenant to get out of property through our lawyer they got some legal aid lawyer to file a lawsuit. This lawsuit is for the cost of what I’ve paid for the house. My advice is to stay far away from these people. Let your legal team do all the talking.

Thanks again, the website is very useful. Whenever I think of their attitude, no rent until they move out, they may “destroy” my appt, or even affect my neighbors, or hurt my kids ( as we live close by), it is a nightmare. We are not rich, just want to get back the condo as my kids are getting old.

If the tenant has the resources, he can possibly live rent free for years by asking for extensions and using his family and situation to find sympathy with the judge. I know if the apartment or building you own is a investment property, it’s better for your case. You made the right choice in hiring a attorney. Save every email, message, and even phone calls that the tenant might send you. Don’t be provoked and keep calm.

Thank you green thinker and resident2 We went to hire attorney to proceed holdover this morning as the lady came to the superintendent and said I threatened them, so the super called us and asked. We told him that we did nothing to them. The super also suggested us not go close to them now as same as the attorney said. The lease will end sept 30 and they still didn’t pay aug rent. The attorney has told it may take 4-6 months without rent, we are so upset and stressful. Please kindly let us know if anything we need to pay attention. Thanks alot

Is the tenant on a month to month lease, or has the lease expired? In which case, call a landlord tenant attorney and start a holdover proceeding, that is the proceeding to evict a tenant that has no legal right to a renewal lease. Let it go through the attorney, keep your distance from the tenant, they are clearly bating for a case, just keep a diary.

Actually I went to police right after we got the message, I told the police and showed him the message if I can file the case, the police said the message didn’t say he will go to police and it is not a crime so I can’t file it.

Don’t stress over it. Send him another move-out letter by certified mail. If he harasses you verbally at some point about it, call the police and file a report. He won’t take you to court because he knows he has no legal claim or proof.
