Existing Air Conditioners

When my tenants moved into my co-op there was an old but working air conditioner in the living room I said I’d leave for them to use. The unit has since died. Am I under any obligation to replace it? Or just allow the tenants to buy their own?

I think it depends on what was stated in the lease and what was said when signing it. If you told them that this is not part of your services and that it was yours and are leaving it for their convenience then I don’t believe you would be responsible. If this wasn’t stated and they were led to believe that it was part of your services then you may be responsible. I am not sure exactly how this situation would work but it sounds like you informed them prior to signing. Best of luck!

Doesn’t it depend on the lease. Was it excluded as one of the services you provide (unlike hot water or heat)? Did you say to the tenant when they moved in that you weren’t responsible for the a/c maintenance? How is that different from, say, repairing the refrigerator or a leaky faucet?
