Addendum to Lease
We have a two family house and our apartment is currently rented but one of the tenants is moving out before the lease is up and a new person is moving in. I need to create an addendum to the lease to take the old tenant off of the lease and add the new tenant but I don’t know exactly how to word it; does anyone have an example they could share? Thanks.

I’m not quite sure I understand. Is the new tenant the sole occupant of the apartment? or was this a share situation and one of the partners is moving out? If the former and it’s a completely new occupancy, then just sign a new lease. If it’s just half of a share that changing, I agree with cmu, as long as you’re happy with the new person, just add his/her name to the lease replacing the person who moved out. In either case, it’s no big deal.

I’ve been a landlord for 25 years and I’ve never sweated this sort of stuff. I use normal English: “The new tenant [name] agrees to all terms and conditions of the existing lease, attached” (assuming you have one.) Get it signed. End.

I would terminate the old lease and issue a new one (I would use the Rent Stabilzation Association’s proforma lease). You can make the term for whatever you like.

How about offering a new lease……you could make it for 6 months if you wanted
