Wrong classification with DOF, bank wants escrow to fix

Hoping someone can help.
At the very end of a long refi, rate expires next week, bank attorney flagged that our brownstone is taxed as a two family with department of finance but instead it is a three family, they want escrow until we fix the issue. Any idea who i need to contact or if i can hire someone please? My attorney says there should not be any increase in taxes or back taxes owed when we notify DOF. We purchased the property one year ago.

DOF has to come out and reasses/reclassify the building. It takes a few months, but it is easy and get ready for your real estate taxes to go through the roof. If the escrow is small enough I’d just kiss that money goodbye and not involve the DOF.

CofO is a 3 and house is being used as a 3. only issue is wrong classification with DOF.

Bigger issue: what does the CofO say? If it is a legal 2 family and you are using it as a 3 family, that is a much bigger deal than just notifying DOF.
