Wood burning Stove nuisance in Brooklyn, NY

A neighbor down the block uses a wood burning stove that stinks up the whole block. We can;t sleep with an open window because the smell wakes us up. I have a lung disease and this is not a good situation. Been living here for over 30 years and am ticked that I might have to move due to this issue. The guy has loads of wood in front of his house that is not seasoned and some is even plywood. This is not a fireplace, but a stove used for heating. I am wondering if anything can be done about it?

How cruel to post pro-burning hearth industry propaganda in answer to this desperate person with lung issues who is in the process of being driven from her home of 30 years by someone’s wood stove.

As many people who’ve been in a similar situation know, asking the neighbor nicely to please stop polluting is almost guaranteed to make the problem worse. Much stronger regulations are needed everywhere to protect public health, and not the profits of the hearth industry. The tobacco companies, back in the day, also insisted that the answer to secondhand tobacco smoke exposure was to encourage “responsible ” smoking habits. It didn’t work for tobacco smoke, and it doesn’t work for wood smoke.

This person’s only hope is to try to get this polluter shut down. Polluting a neighborhood and endangering people with health problems is not ok.

I’ve known many people in your situation (including myself). This is a serious health issue — there is a vast amount of research that shows this kind of pollution is at least as harmful as that from traffic, and in some ways is even more harmful. It’s a myth that burning the “right” kind of wood will clean the air (although plywood is especially toxic!). The hearth industry spends millions fighting clean air legislation and promoting burning (they are behind the Burn Wise page linked to in another comment). The problem is only getting worse everywhere, but municipalities do little to help the victims.

What does this mean for you? You can try complaining to the local authorities (are other neighbors suffering too? If you can get others to join you in complaining, it might help.) It is specifically illegal to burn plywood in NY (this is for open burning, but I’m imagining wood stoves would apply too): http://www.dec.ny.gov/chemical/58519.html If you can somehow prove he is really doing that, you might be able to get him shut down.

Aside from that, you can get expensive HEPA filters to try to survive. But at the end of the day, you, like many others in your situation, might very well be forced from your home of 30 years if you can’t get someone to make this jerk stop burning. This is more than even a lung issue (although it’s dangerous for someone with a lung disease) — wood smoke is also toxic to the heart, raises your risk of terrible conditions such as stroke and cancer, and the latest research shows clear evidence that it also increases your chances of eventual dementia. I wish I knew of better options for you, truly.

Good luck to you. I hope the fact that he is burning something illegal might help you to get this stopped.

When you say stove do you mean an interior kitchen stove for cooking or an outdoor stove commonly used by faux-conservationists for space heating? These outdoor units cause local pollution unless an appropriately-sized chimney is attached.

In 2014, the city banned new wood-burning fireplaces. I believe there are also rules about how wet the wood used can be but I don’t know if this applies to a stove as opposed to an open fire. I found this online and I’m sure 311 could tell you more. “Under the new regulations, residents who already have wood-burning fireplaces or who have reconstructed their fireplaces prior to that date, would be allowed to use them, but with the requirement that they only use firewood that has a low amount of moisture (20 percent or less), which are less smoky when burned, according to the Department of Environmental Protection.”
