Water Back Up and Board Ignoring Me

Dear Community, I have been a property owner for a year and 2 months. My apartment sits on the sewage line and during heavy storms waste water with particles backs up into my place flooding all rooms. Photo evidence available. The Property Manager has ignored me for about 8 months. I have been persistent, got the attention of the Board, but now the Board is ignoring me. Anyone knows what I can do? I am looking for legal assistance as it is not possible to live in such physical and emotional state. Any help or words of wisdom is highly encouraged and deeply appreciated. Thanks!

@cate: i used to work for a management company. my guess – and this is only a guess as i was a hands-on person in the field – is that the OP would be assuming an awful lot of liability and responsibility if they proceeded with this on their own. in their current situation, they are well within their rights to sue the board – but if OP has the work done by himself, he could be on the hook, not only from the board but the other owners if something went wrong. and who knows the extent of something like this with a sewer line. my guess is, that this issue is a lot more serious than a simple leak and that is why it is not being dealt with.

the sad part is, this person should not have to consult with an attorney to get action.

Yikes, I am so sorry to hear of your troubles. One little thing to keep in mind: If part of your apartment is in the cellar, that area is not considered legal living (sleeping) space. The easiest and cheapest thing is probably to have it fixed yourself and then bill the responsible party. I would first discuss my options with a lawyer and make sure I proceed correctly legally. Is this a problem the previous seller or, if a new unit, the developer covered up?

how is this stuff entering your unit? can you be more specific?

i have had two situations like this – one that i experienced first hand and another that someone i know went through – both in multi tenancy or attached buildings.

here is the trick to dealing with this: you have to find a way to make the problem everyone’s issue. right now, one of two things is happening: they think you are a pain in the neck and just complaining or they feel your pain but do not have the money to deal with it. what you have to do is find a way to make this EVERYONE’S problem and when you do that, they will listen. and if they do not have the money, when it is everyone’s issue the board can find a way to raise the money (special assessment) as they will have less resistance from the other owners.

if you tell more, i might tell you how i dealt with a situation like this and i did that after hearing how someone else dealt with this kind of situation. the question is, through where is this entering your unit?

Common plumbing such as a building trap should be a board issue instead of only a unit owner issue. Accurate diagnosis helps. I’ve hired IMP plumbing to successfully camera scope a buried cracked drain blockage for significantly less than another plumber. Still it wasn’t cheap. Maybe tell the property manager and board you plan to hire for the work and seek reimbursement as a common area expense unless they advise otherwise
