too high of a fence

I am not going to die on the hill defending chain link fences. But years ago I took down the decaying picket fence next to it, to increase the light in my garden. It is mitigated by wisteria, vines, a stairway coming down next to it. I think the current trend for isolating wood boxes dividing one back yard from the other can be an eyesore as well. I have a diverse set of dividers – the chain link fence, a concrete block wall (8 feet but hides the underside of the deck my behind neighbor (I’ve covered it with climbing hydrangea), and a 6 foot wood fence. It is delightfully discordant.

We recently put an offer on a brownstone in Brooklyn. The previous owners put up a 8 foot fence- though its technically 6 feet high from the highest point of the shared wall. My question for the forum is that if this ever does become an issue- would I have to completely remove the fence, or would the DOB allow me to rectify the issue- in which case i could cut the wood fence from the top.

I reminded my neighbors of the code when they were putting in a new fence – I was concerned about losing light in the garden – and I find the higher fences claustrophobic. On the other side my neighbor and eye have an open chain link fence that allows for neighborly conversations and mutual admiration of our gardens. Privacy is over-rated.

i disagree. their deleterious effects can be mitigated, but that just means nice plantings are really pretty
