Ticket for garbage that doesn't belong to us

I fought and won a $300 fine for a neighbor’s un-wrapped mattress on the curb. The neighbor was a jerk, so I didn’t deal with him. I took pictures and got two other neighbors to write letters that they saw that the other guy put the mattress out. I submitted it all through the online system.

Hi all

Wanted advice on a matter. We were given a ticket for garbage that was put in front of our house. We definitely know it wasn’t ours as we are currently not living in the house. It is a small amount ($25)but a matter of principle.

How can I fight this? It is hard to prove that our neighbors will fess up to this (rental building with many tenants).

i tried to fight one for the exact same reason…..went to my hearing, presented my case (someone else dumped that garbage in front of my house, what else can i say?!)……and i lost. $100.

Take it up to the Supreme court- the city claims ownership over the sidewalk and streets so it is their property, and not yours which should be ticketed for strewn garbage.

Let them argue the spurious claim that random homeowners are considered unwilling custodians of public property just because they happen to live near some unkempt city property.

Sorry, it’s unfortunate, but you can’t fight it. If any trash is on the sidewalk, or in front of your house, then it is the homeowner’s responsibility (even if you didn’t dump it). The only time the city takes responsibility is if the trash is in the street in front of your house. Then you can call 311 and sanitation comes to pick it up.

You’ll never win unless you have photos and have a complaint into 311 for “illegal dumping” before the ticket is issued. Fighting violations in person is your only chance at winning or having the fine reduced.
