Tenant wants lead testing.

She said pediatrician tested her toddler for lead and she has level above the treshhold.
Now… we do not have anything that we did not touch in this apartment for 20 years.
Floors throughout the apartment is new oak about 12 years old, all new windows with new frames and windowsills, some replaced twice, wood trims were sanded,
stripped in some places, floor basedboards sanded or replaced and painted..
Kitchen was moved with an architect permit, original room taken to the studs, new kitchen – almost everything, and tiled over.
Bathrooms were taken to the brick, all pipes replaced, wonderboarded and tiled, new watermain…
Ceiling – we have original only in 2 rooms, one – painted over tin and one – plaster.
The rest was replaced with sheetrock or laminated with sheetrock.
Walls – either were skimcoated in 2 larger rooms, or sheetrocked.
We had 5 families in this apartment, naturally, we renovate and paint each time. We do not like paint caked over, so, patches and all woodwork was lightly sanded before new coat of paint.

so, everything was painted over at least 5 times .

I am at loss: what could be wrong. Thinking about it – we have nothing to worry about. We raised our child in apartment below, and it was much less renovated while our child was a toddler. We did lead testing on her too, and it was normal.
We had many toddlers in the apartment I was describing. 6 toddlers to be exact. Never had we face this problem.
Still I am scared to death now.

The city is wrong headed about this. They want housing. These are the houses we have and unless a family has been living on some sidestreet in bushwick since 1945, all of us – tenants, homeowners, landlords alike – made a choice to come here and, in spite of known risks, live in these places. Even if a landlord is not negligent in their maintenance, there is still going to be some risk and that risk is a lot to place on the shoulders of small landlords. Look what it just did to you.

I said it to a customer the other day; “after reading what i just did about lead and the risk to landlords, if i were a landlord, i would not rent to children”. That is the message this sends to us.

Those days I had to take again some leftover high blood pressure pills that I still have after my high blood pressure was resolved for good some time ago.

Technology is super helpful… until it fails. Glad this worked out the best way it could have after the false positive. In my experience it is better when freaked out tenants in scenarios like this do not end up renewing their lease. Better for all if they are living somewhere they are comfortable to live in instead of living as if on a hair trigger waiting and watching for another problem with the apartment

But what a learning experience. This was an experience money can not buy. Save the dust tests the inspector did so if you ever have a problem down the road you can prove you had a test done and it was negative.

I almost said it the other day, that this will turn out to be nothing.

Homeinspector’s last comment is a VERY helpful one to consider. Just today I asked an insurance inspector to stop our conversation until outside and away from the building. It is too much for landlords to manage property conditions and unnecessary tenant anxiety. Better to have potentially fear inducing conversations with experts away from tenants instead of in front of them if possible. I value vendors who can navigate this issue well

If you get him to come in when they are there, have him say less in front of them and prepare a report for you later.

We had to deal with potentially unsafe conditions in buildings and we never discussed things in front of the occupants. We were not even allowed to use the word asbestos outside of our offices. Be careful. She will latch on to anything you or the inspector says and use it.

It is not about access denial. It is about them to hear what risk apartment posses.

Inspector who did x- rays said he does not see anything that needs attention.
But he also mentioned that it is not a risk assessment.
I suggested we will remove shutters.

OP you should have a clause in lease that covers the issue of tenants not needing to be home for landlord to provide access for necessary repair, maintenance, etc. Tenants often tell me a contractor’s appointment doesn’t work for their schedule, and I often reply with “not necessary for tenant to be present” because building staff will provide access. Often times tenants don’t push back on this, especially when you hint if necessary about tenant’s denial or limitation of access for necessary repairs causing unnecessary limitations and harm to landlord per the terms of the lease. And of course you can go the route of making the lease the bad guy and the landlord the good guy who says we can overlook this first refusal as a courtesy but we can’t keep rescheduling entirely at tenant’s convenience if there are other limiting factors making doing that too difficult for landlord
