tenant paying on the 15th and only half the rent

I have a tenant paying late (on the 15th) and only half the rent with no really good reason. They didn’t lose there job or anything either. They are just taking advantage of the fact that evictions are not happening but I am pretty sure I can start the case now… Should I start an eviction case now? I know if open a case I will not be getting ANY money at all after that. Should I wait it out or start the process now? This has been going on for months and I am fed up, esp when I have other tenants pay in full on time every month.

My point is that being eviction proof may not be enough protection if they are not judgment proof. If you can obtain a money judgment, you can garnish their wages, or repo their car. It might be stick enough to get them to pay up.

I have respected and been lenient with all my tenants. Anytime they have any issues I come the same day to fix it.

I have done nothing to deserve this treatment from them, but I understand there will always be that bad apple.

In the future I will be even more through with my tenant checks but honestly perfect tenants can suddenly become horrible ones.

This is a bad situation, if they can show ANY hardship you can’t even file a case for eviction until May 1 at the earliest and they say Covid protections potentially may extend.

Also, where is the dysfunctional at best housing court system going to be at once the ban is lifted? Are we going to be looking at year+ backlogs?

I hate to say this, but you may want to consider swallowing your pride and offering them a few months rent free if they will leave (assuming its a market rate apartment).

If they are not a professional deadbeat and you ran a credit check before renting to them, the leverage you have is their credit. You can first notify them that you will be forced to seek payment of back rent in housing court and it will affect their credit.

I’m not a lawyer but i believe you need to serve them a rent demand form, which must be served three days prior to filing anything.

You could remind them the ramifications of having your landlord get a judgement on your credit report – finding a new landlord (who would touch them?) nor a mortgage (not happening).

When you send them the rent demand form (find one online), you can remind them of these things and you may be forced to file a lawsuit and seek a judgement in housing court. If it is
(was) an honest person, perhaps they will decide the bad credit isn’t worth the scheme. There are forms online i think you can find, and you are obviously not obligated to do anything but you do need to let them know you are not going down without ramifications. Whether or not you actually go to housing court is up to you.

@dork: assuming what the op says is true, the person doing this to them knows the law better than 99% of the people out there and is using the law to their fullest advantage. the attorney will not tell them anything they do not already know and do not already have a contingency for. i suspect that however this ends, the landlord will be out money and the tenant will have gained.

Although you may not be able to evict, you could in theory sue them for the back rent and garnish wages, seize assets, mess up their credit, or take other collection action.

Now I’m not saying you should do that. You make it sound like these folks are being obnoxious, but they’re paying half, so I suspect there is more to this story, so try to figure it out and don’t be a jerk.
