Sidewalk Lien Violation and refinancing
In the middle of a refinance and just remembered I have a sidewalk violation from many years ago for trip hazard on my property. I remember it being a pain to fix. Tried to get Parks to fix it back then because it was related to my neighbor’s tree roots. They said it wasn’t the tree even though that’s the only reason the ground was coming up. Maybe because the tree wasn’t right outside my house? The neighbor’s tree was actually worked on by Parks for free so we saw the roots coming to our side when they dug the concrete up. But I guess by the time Parks came to inspect our site, the neighbor’s tree and sidewalk was already fixed nicely.
DOT then ended up posting a sign on my door and said they would fix, but they never came, and I just forgot about it after trying to track them down endlessly. Recently, I had some driveway work done and the workers ended up grinding down the trip hazard so that it is smoother (i have kids playing outside)
Now I have decided to refinance and it occurred to me this violation might be an issue. Anyone have any experience with a refi and clearing sidewalk violation? The original trip hazard itself wasn’t that big so I am hoping the bank will see that it isn’t an expensive problem. Ideally, I’d like to clear the violation but I’m, not sure it was done properly since the workers didn’t get a permit. (I didn’t hire them for that specific reason, they just ground the trip hazard down as a favor for me). I don’t even know if it counts as patchwork since they didn’t replace the whole square and just ground down the cement.
Anyone also have any good outcome from having their sidewalk lien removed with the new program by DeBlasio, which apparently would remove a sidewalk lien due to city trees? Thanks.

It’s just a violation that carries no penalty, no issue. I have one as well, waiting for many years for them to come fix it and bill me. It goes through your community board for some reason
