Sanitation ticket has totally false description of offense... how to fight this?

Sanitation is a tough battle. We are doing it now as our building is commercial but has Five Residential units and is in a secluded Industrial Block in a Residential Area. We were told to reach out to our Council Representative so we did and waiting to hear back from the super.

I packed up half of my deceased fathers hardcover books (mostly books of subject and condition making them impossible to donate) into 10 heavy duty plastic bags and put them out for the garbage. Before doing so I confirmed with 311 that this is regular and not recyclable garbage and that the amount and weight were correct and lawful. The garbage men did not pick it up. I pulled all ten bags back and put them out on my second pick up day and again they did not pick them up. I made a 311 complaint of mis-collection and they finally picked them up. Only a few days later I got a summons stating that the Superintendent under penalty of perjury personally observed that these 10 bags were mixed with plastic and wood pieces and not even tied up. This is completely false. ALL bags were hardcover books only. Don’t know what to say in my defense now other then that is begs to reason that I would make a mis-collection complaint if I was putting out such a mess. I am surprised and disappointed that such a false description is pressed against me when in over twenty years I have been careful and considerate in placing garbage out.

I do not think they can quash tickets that way. It has to somehow be ajudicated – through the court. I think my neighbor got a ticket a few years back that was supposed to be for another neighbor. I might ask what he did but he might have paid it.

Those of us in business get non sense tickets all the time. Not worth taking the time off work so we pay them. But the city knows this so they issue nonsense tickets knowing we wont fight them. I pay them as if i am doing my part, like supporting a charity.

Its a vindictive ticket for filing a complaint. But probably not worth fighting, unless you have lots of spare time on your hands & a masochistic streak.

If you have the time, I would fight. The supervisor has a lot of explaining to do, especially since there are records of your calls to 311. And I would also involve the Council member, too. Not sure what the violation would be if there are mixed kinds of trash, as hardcover books are not recyclable. And a homeowner is absolutely allowed to dispose of home improvement debris.

When I have a lot of trash to toss, I will put out over a few days so as to avoid intentional non-collection.

I feel your frustration. I fought a sanitation tkt. last spring out of principal. They weren’t doing live hearings due to Covid and not even virtual. So I pleaded not guilty and even submitted security cam video stills showing there wasn’t trash 18″ from the curb, as the ticket claimed, My case was denied and I had to pay. I don’t have the time or fortitude to take it further. I’m grudgingly resigned to accepting it as just another cost of doing business as a homeowner. That aside, may I suggest you never put out 10 trash bags at one time (assuming it’s a smallish bldg.). I learned from experience that it’s cool to place up to 4 large contractor bags at a time. I usually stick to 3. That’s based on my having asked my local sanitation workers why they weren’t picking up everything.
