Rooftop Additions
Your original condo plan will tell you if the top floor has full roof rights.
The chances are that your neighbors addition will not get DOB approval because if there was any additional build-able square footage, the original sponsor/developer would have taken advantage of it.
But that said; the costs off all the plans, engineering requirements etc etc. will probably slow your neighbor up plus he will need the majority of the rest of the owners approval and the board can require your neighbor to pay additional common charges, he will get a RE tax re-assessment besides the costs of the actual construction…. it would be easier and probably cheaper for your neighbor to sell and buy a bigger apartment if he wants more space.
But look at the rules, by laws etc of your condo plan and get the board to consult an architect/attorney yourselves before seriously entertaining any kind of application to the condo from him.

Hi Brownstoners,
Need some advice here. I live on the garden floor of a brownstone condo. The top-floor neighbor wants to build a living addition on the roof. I’m not sure if he has roof-rights (he does have a roof-deck up there). I think he would just build a master bedroom on the back-half.
Besides reduced sunlight in my garden, what other changes can I expect if he builds up there?
He told me he has checked with someone on building codes, but is there a way I can check if / what is legal?
Lastly, he’ll probably need a majority of the condo tenants to approve these changes, but I really don’t see any personal benefit to this project. A friend of mine said we should ask for some sort of remittance/ payment for the inconvenience. Sounds a bit shiesty, but I’m not thrilled with construction, loss of sunlight, and other unknowns. Thoughts?
