make a written set of rules for the building. hand them out and speak to them as you do (nicely as the voices of reason suggest). then the next time they leave stuff out, enforce it the same way some others or Jeremy have suggested. Give them a warning first and the next time act. we went through this on the 72 unit property i managed once and because there had never been a dedicated on-site person in the previous five years of the places existence, it was hard at first but after a few months of back and forth, they got it. for new tenants who came in, they knew the rules as only one way from day one so it was not so bad. it was the older tenants who were a problem to deal with. know this: if you let one person slip, they will walk all over you. you have to “nip it in the bud” the moment it starts. and by the way, that was the term we used with tenants and commercial building occupants: “nip it in the bud”.

We have a big issue with crowding common hallway and stairs: shoes racks, strollers, other staff.
All explanations, warnings even beggin does not work. We stressed several times that common hallways are not included in rent to keep personal staff except mail, an umbrella strollers and kids chalks box. They just do not comply.
All our tenants are paying rent on time and we do not want to turn it into neverending fight.
Now we have a situation when we warned all tenants 3 weeks ahead that we plan to renovate hallway, paint, replace carpet etc, so, please, remove all your belongings. We plan to start this Wednesday. I sent another reminder because our contractor is there today and he asked me when to start because all this staff is in a hallway.
How do you enforce this things? We can decide not to renew leases, actually, all of them currently under market , but how do you deal with this kind of hassle in general?

the same way you would deal with an 8 year old child who refuses to clean their toys up.
i took care of a 72 unit property once in North Carolina. one time i got to work and some red neck (the brother of a pro ball player) had parked his car on the lawn. I called my boss and he said “go tell him if the car is not removed from the lawn in one hour it will be towed”. problem solved.

keep it simple. we tell our tenants that hallways must always remain clear for “egress” and “fire safety” reasons.

they will not listen. OP has to put something in writing and tell them what will be done.

One tenant with a stroller-monster totally blocking a stairway when I wanted to go upstairs showing up one day said:
if you got fined we will pay your fine, now, sorry, I have a remote meeting 🙂
I just do not want to start a fight with tenants. They do pay rent on time.
But it seems there is no way around.
Also, our wainscoting suffers greatly with all those bumps and chips.
I just have a collect some nerve to confront all of them, I guess.
When we lived in the building it was much easier ( actually.. surprisingly, when we lived in the building nobody had ideas to put shoe racks and other things in common hallways, we had a mirror, mail rack and some old NYC art on the wall – that’s all).

I’m not a landlord – but in our condo building we recently had to clear out a room in the basement where everyone had been storing things for many many years despite being told not to. Our solution was to let everyone know that they had x amount of time to clear out their things and that by x date we we were hiring someone to come in and clear it out and that anything not gone would be considered trash. And we followed through – and threw out a LOT. Perhaps something similar could work.

Yes that is the best approach. I would let them know that you will be performing work in the hallway in the near future. And for the safety of those who enter the building as well as the workers performing the job any items left out after a certain time would be permanently removed. This rule will remain in effect after the work is performed.

Is this in a rider to the lease? If so, you can refer to the rider and that they are in violation of the agreement. If there is no rider, you need to stipulate everything outside the boilerplate lease. You have the right to remove the items if the tenants are given ample time (5 days?). You said you don’t want to start anything with them, but it seems to me you have been more than patient, more than fair, and just because they pay the rent on time (which is what they are supposed to do) that doesn’t give them the right to step all over you. Back up whatever you say in an email – and if you do not want to engage with them, communicate this only thru email. Seriously, you are the landlord and own the building, they are walking all over you. If they don’t like it, they can go out to the rental jungle and try to find another apt. There are plenty of people who are looking to find a place, you would not have a problem replacing them.

Make a notice that you will set all personal items to garbage by certain date, then act on that notice. You could pick the day for bulk garbage and recycling day and set straight to curb. They won’t take you so lightly after that

Consult with a lawyer before acting on this as who knows what arcane New York laws preserve rights to common areas.
Otherwise, per Jeremy, send a letter to every tenant in the building, certified mail, that is polite and specific and which poses the issue as a building-wide problem. Something like “In order to address ongoing concerns of cluttered hallways which are a safety and fire hazard, management will be instituting a policy beginning in 30 days. From then onwards any and all items that are left in the common areas of the building will be disposed of on the next occurring trash/recycling day. We understand that may cause some inconvenience, however it is a necessary step to maintain the condition of the building, and the safety and the access and enjoyment of the common areas by all tenants of the building.” Then place more than one sign on the walls on each common area of the building saying “any items left in common areas of hte building will be dispos ed of”.
Maybe for the first month put anything left behind in a storage space somewhere and have tenants pay the monthly fee to get their stuff back.

You need to figure out what you want here. Obviously, you could be confiscating things left in the hall, and only returning them when you’ve extracted a promise (in writing) to not obstruct the hall again. But you haven’t done this. So, how much do you really care? You need to figure that out. You mention they pay their rent on time – are you reluctant anger people who pay their rent on time – is that why you haven’t acted? You need to figure out your priorities. You can’t just make people do something you want unless there are consequences, but you seem reluctant to enact any consequences. Perhaps you are happy to keep your tenants in place, because they are paying rent, and just be constantly nagging at them … it is possible this is your preference. Just hope there is not a fire in the building, and that no one trips on anything in the hallway and injures themselves.

Instead of “warning” tenants, have you considered talking to them as people? If you’re receiving rent on time, it sounds like the only affront happening is your perceived elevated status of landlord isn’t taking you as far as you’d like it to. You may own the place, but that is where these people live. A little grace never hurt anyone.

Colonial, i’ve managed buildings. Op has tried that with them. Commercial is easier because there is always a supervisor we can go to but residential people do not give a toss. Part of it is that some tenants are tenants because they do not want responsibility (i miss being a tenant for this reason). To get some of these folks to respond, there has to be some other mechanism. The organization i once worked for put out a list of rules and include a line about storage in common areas and i think the board told them it would be disposed of after a certain date. In that case, most of the occupants already hated the board so it did not matter but op is trying to be nice and it is not working.
