OK I need some help I been living in this house for 7 years the landlord passed

i am not a lawyer and admit that i could be wrong about some of this but i have done a lot of hiring – both contractors and employees (under the guidance of HR personnel) and i work as a contractor, so some of this will make sense. And yes, OP needs to consult lawyers.

OP probably had a casual arrangement made between himself and the landlord (as a person). when people enter into agreements (a lawyer told me this when i set up my first corporation) we represent ourselves as a person unless we state we are representing a corporation (or in OP’s case, perhaps a trust via the landlord). So OP, you state you worked for him and he owes you money. Did he say you work for a company that owns the property? Probably not. you worked for him.

what kind of work did you do? where you working under his direction? were you taking out the trash and painting or did you do actual contracting sort of work on your own? if you worked as a contractor doing repairs and have proof of this and if you are a licensed contractor, you could have put a mechanic’s lien on the house. But you would need to have had a written contract. That lien would have to have been applied before the house sold. if he stood over you telling you what to do, you were an employee and you need a labor lawyer (it might be too late, the estate might be settled).

Did you want to buy the house and do you feel you had a verbal agreement with the estate or whomever and were you negotiating in good faith, meaning did you really think you could put the resources together do get the house or did you think you were owed something (that you might have no written agreement to prove) from the person who died and were you thinking that would serve as a down payment?

it sounds to me like you need a labor or contracts or real estate lawyer. OR:

you simply wish to remain there at reduced rent? maybe you need a landlord/tenant lawyer.

When things go wrong with these “casual” work arrangements, questions of responsibility come up. You feel someone has a responsibility to you now (and this may be true depending on circumstances that we do not know). there is someone else on this board right now, looking to hire what i would guess is an adult human being (they state handyman or carpenter) “by the hour” to perform work on their deck. They are probably not thinking that this human being deserves worker protections. If something goes wrong in this “casual” arrangement – if the worker gets hurt or feels they did not get paid fairly, does the customer have any responsibility to the worker? That is the same place you find yourself right now. Most likely the customer will say the worker was a contractor (with no written agreement) and guess what, customer wins, worker loses. I want to point something out to you. if you are not white like i am and have never moved around this city doing work like i do, you might not realize that the people hiring other human beings for “casual” work (under 19th century work conditions) specifically avoid white people and target minorities because they have realized that white people – with their better education, language skills, understanding of the legal system, and access to professionals (like the attorney-customer who warned me that unless i say i am representing a corporation, i am really representing myself as a person) – will protect themselves with all sorts of things including insurance and contracts and a business structure and they know that all of this costs money and the white worker will demand to get paid the cost of covering these things. What i am saying is, there is an element of racism to these practices – and probably what just happen to you. Unfortunately, in an increasingly conservative environment where labor laws are not enforced (and you might have been entitled to some of that protection as well, perhaps has you been paid as an employee you could have gotten unemployment insurance after the landlord died) and no one is held accountable, it is up to us, the individual, to protect ourselves.

Good luck. I would seek counsel of a labor lawyer, contracts lawyer and housing or tenant lawyer.

And was working for him to so he passed away now after 7 years this lady is claiming to be the new owner she said I can buy it but she did not give me a chance to pay her she sold it what can I do OK if it’s her house OK but should ent she have to pay me for caring for the house allthwes years please some one let me know

You would have had to put a claim in with the estate. It was an estate matter, not the person who got the house. You were working for him.
