NYC Code for fence height on a raised deck?

Resident2 and Carriagehouse99: you’re conflating temporary shed and fence rules.

A temporary shed made of flammable material must not be within 3feet. Permanent sheds proven to be constructed of non flammable material (cinder block for example) can run right up to the house.

Residential fences are considered permitted obstructions. When installing in the rear lot, max height six feet, it needs no permit, can be homeowner installed, and wood is fine (as is plastic, brick, chain link). Being a permitted obstruction, this can run right up to the house AND be built ON your property line (IF your neighbors don’t object, which they likely will) in which case, you build 2 inches inside your property line. Between the NYC Dept of Buildings and the NYC Dept of City Planning you can find this clarification.

Looking for facts on deck fence height limit on a backyard deck raised 4 ft above grade, a 6ft fence would put it 10ft above grade. Not sure it matters but ground floor is raised 4ft above a true basement-non parlor level. Residential single family

A deck railing should be 42 inches. If you’re talking about the sides of your deck, it would make sense to keep it the same height as the railing in front.

Deck goes to the property line and I would like to do a 6ft privacy fence on the deck sides
Same as the property line fence but this would make it 10ft total from grade at sides of deck, beginning of backyard fence. Saw some references in DOB to permitting 10ft

That pertains to the backyard fence in general, so firefighters or who ever; have a chance of getting from yard to yard if push comes to shove. While the nyc building code allows for a fence height of 10 feet, the NYC zoning resolution limits it further by stating residential fences to be at 6 feet. But, it’s not like you want to put a 10+ fence on the whole lot line. Just the first few feet from the back of the house. This is also one of those things thats not really enforced, i’d go ahead and just do it the way you want. Worst case, your neighbor gets annoyed that you’re casting a shadow onto his yard and calls 311, and the compliant gets closed after no one provides access to the yard.

As Green Thinker states, you would likely put a parlor deck privacy fence only on the first few feet away from your house, not the whole lot line. It normally is incorporated as an incombustible iron fence frame with ‘detachable wood screens’ . Re parlor decks, NYFD needs 36” to 48” wide incombustible flooring from house door to stairs to backyard as egress re’ 1-2 Family dwellings.

jetsetterjason: Fire-codes dictate no flammable materials within 3 feet of the property line, just as you cannot use wood decking with 3 ft, you cannot have wood railings, fences etc.

I believe Backyard Fence (and Shed) compliance can be visited @ NYC Dept of Planning and Zoning at 120 Broadway-31st fl., or by consulting an architect experienced with Residential Landscaping, and that surveys determine the exact rules for each individual back yard property.
