Nuisance trees in back yard
Agreed, talk with the owner if possible to find a solution. You can, of course, prune whatever is on your property, but that doesn’t solve the overall problem. If needed, offer to chip in for removal or cutting down to the stump. If the tree falls on your property you will need to pay for removal so better to spend a bit before actual damage is done. This happened in my building last year – a neighbor’s multi-story weed (ailanthus) tree fell and hit three other properties. We had to foot the bill for removal of whatever fell on our property. If the neighbor isn’t amendable then make sure to put your concerns about the nuisance tree in writing, putting the neighbor “on notice” of the issue will help put the burden of removal on them if the tree falls as they were notified of the issue and did not address it — if I remember my looks at NY’s tree laws correctly.

Who’s responsibility is it to maintain trees in back yards. We have a neighbor who allowed a weed tree to grow over 40 feet high. Its planted with a few feet of the walls of 3 houses and has taken over the backyards including roots pushing up pavers and patios. We are also concerned a wind storm will knock it over destroying decks and fences which insurance will not cover. Any guidance is appreciated

Talk to your neighbor. Nicely. If they are in a good financal position and consider this tree a weed, maybe they will do the right thing and have it removed. If they are older or people who have inherited the house and are simply living there and have limited resources, maybe some people can chip in to have it removed.
About weed trees. Two popped up here on my side of my neighbor’s fence but on their property. My neighbors do not like trees so i let these grow to see what would happen. As soon as they began to bow over their fence, they began focusing on them and trimming and cursing mostly because they could not get rid of them (without my help). I don’t want them here either (the weed trees, not the neighbors) so as soon as they asked for my help i hit them with round up hoping all this would go away. The leaves died but within weeks more green appeared so i hit them again. That was last summer. This spring i realized they were going to come back so i cut the remaining trunks down. Sure enough, they are sprouting dozens of trees at the ba se. At this point i am not sure what will be easier to do: attempt to remove the trees, move, or suffer it out until i leave in a wooden box and let someone else a lot younger deal with them.
Good luck with this. Even if the people who own that property want it gone, there may not be much they can do about it.

“Weed” trees are a subjective concept. After pulling out many seedlings over the years I allowed two volunteers, an oak and an elm, to grow in my back yard because they happened to sprout in places I considered appropriate. They’re nii I w quite large, especially the elm, and provide wonderful shade. I’m sitting in my garden as I write and, on this 90 degree day it’s cool and comfortable. Of course I didn’t object when my neighbor trimmed branches overhanging her yard, as was her right.

I agree as I had a similar issue. Best option is to speak with the neighbor and hope he is willing/understands the problem and that it is his tree causing the issue
