Neighbor won't give me access to repair my stoop

Long story short. Finishing up a really drawn out renovation and my neighbor won’t allow access to their front courtyard so we can finish the brownstone on my side of my stoop. The renovation took a long time and I feel bad for them living next door to us but they also have called the DOB with fake complaints over and over again in addition to them saying some truly awful things to us, wishing we go bankrupt etc.
They state we damaged their property but they won’t provide proof of anything in writing though I have asked. What rights do I have to repair my property from their front yard? I would certainly repair any damage to their property but I still don’t have any proof that there was any damage other than the general annoyance of living next door to an on and off construction site.

an 881 could work but speak to a lawyer, its not unusual for the judge to make you pay for the license

FYI – NYS law requires them to allow you to access their property to repair your property. The law is called the Section 881 of RPAPL The Real Property Actions and Proceedings Law. Link below. If you are not able to reach a deal with them then you should start a proceeding and they will probably realize that they will lose the fight..

Karma never loses an address. You may need to report them and let the various divisions get involved with forcing access. As long as you make sure the contractor leaves it pristine when done. I did work on my home and my jerk neighbor kept sending cease and desist letters from her attorney. A wonderful architect from LPC (back when it was wonderful) showed up and told her that most brownstones share a common wall about 3-4 layers of brick deep. In essence the few inches needed for the guys to stand on was considered “common” and we were both responsible for its maintainance. Needless to say she had to fall back. The work was done and God swept her from my life and to this day we haven’t spoken so wonders never cease.

Obviously, if it’s about to collapse, then yeah something needs to be done. You’ll have to get a lawyer involved and send a letter, then go from there.

But if it’s cosmetic, f-it, and f-them. Those were some harsh words.
