Need Advice re being a coop owner and facing eviction

It depends on what kind of Co-Op you live in. HDFC?, Mitchel Lama? Private market rate? But your fathers estate of 6 years ago should have settled the ownership of the co-op by now. But during all this time the maintenance should have been paid. You need an attorney to sort out the estate issue and they should also be able to advise you on the non payment eviction case, the co-op may have just gone the non payment route because it is quicker than going the ownership/occupancy route, all depends on the type of co-op as to if you have a right to take it over from your father. But the bottom line is the maintenance has to be paid. If you have a right to take over the ownership, and you can show that you can afford to take care of the obligations of the maintenance, then the co-op will work with you, within the rules that they have to work with.

Hello. Would appreciate any solid advice. My father died 6 years ago and I have been living in our coop in Brooklyn for over years. I am the administrator over the property. We have no mortgage the coop is played of just maintenance I own maintenance for over a year. I’ve recently been served the petition on non payment papers. What can I do to stall proceedings and or try to make arrangements to make payments monthly. Can they evict as apartments do even though I’ve payed off my mortgage. Would really appreciate any incite.

Contact the board to offer a payment plan. It’s expensive for them to pursue this as a court action and you will need to pay up to stay. Show some good faith.
