Mold in my condo building, who is at fault?

Your upstairs neighbor cannot see into apartments below to see what maybe leaking…. so how is it her fault that she did not know.
Filing insurance claims for every blessed perceived fault, is a waste of time and puts your premiums up, so what are you saving?
If she has fixed her leak, then just go a head and each fix your own issues and pay attention to what is happening in your own space in future.
Why are you wanting to place blame & fight all the time…. shit happens, especially when living so close to each other.

Dear Brownstoner Community,

I’m having a dispute in my condo building. My upstairs neighbor had a leak in her AC unit that went on for a very long time. I now have mold in my AC units closet, and there is a fallen-in ceiling in another neighbors storage unit. There is also minor mold in another neighbors apt and yet another neighbors storage. The damage is extensive. The upstairs neighbor feels we should be splitting the cost because she feels that it was due to our negligence that the damage became so extensive.

There was a report about the mold in the storage unit a year ago and that neighbor (the one with the fallen-in ceiling) didn’t do anything to look into the cause.

There was no report about mold in my AC unit closet, so I don’t feel I’m at fault here. I noticed the mold once I knew about the damage in the storage unit.

I don’t feel that I’m at fault and I keep suggesting that we just file a claim with our insurance companies and let them battle it out, but the upstairs neighbor doesn’t seem to want to go that route. What would be the pros/cons re garding filing with insurance. Does anybody have any advice as to how to deal with this dispute? If we don’t use insurance how can we come to a fair compromise?

Why does whatever that person want stop you from filling with your insurance company? That person is never going to agree that they’re liable, and you’ll never be satisfied with whatever they deem is the solution.
You take care of yourself and your unit and let others figure out their recourse

Have you gotten an estimate on how much it will cost to remediate the mold in your unit only?

Don’t delay on filing a claim. You may have timely notice obligations. OTOH, what is your deductible? Only worth filing a claim in excess of your deductible.
