Local Law 152 inspection done

Started this cause other thread was closed for discussion. WTH?
Just got the inspection done earlier this week.
I got quotes for a 5 family from several places that ranged from $599 to $2500, and some with additional charges if gas lines are visible on floors beyond the basement.
Some didn’t have availability until 8 weeks out.
Even if you don’t have gas lines in your multiple dwelling, you have to do an inspection.
I got it done by www.keepmygas.nyc. They aren’t the cheapest but fair pricing, had quick availability, were knowledgeable, with no nonsense or add-ons.
They don’t go into tenant units at all. They did carry gas sniffing wands but they’re not connected to utility. If they find a major issue they have to notify utility and stay there until utility arrives.

Can someone tell me if it’s true that any licensed plumber coming in to do this inspection his natural gas sensor is connected to National grid and if it detects any leak it reports back to National Grid that there’s a leak and then he is legally obligated to shut down gas service to the entire building??

Some people are asking me for a “pre-inspection” for fear that a problem found during the “real” inspection would result in an immediate termination of the gas service to the building, as is the DOB’s stated protocol. I’m also seeing that prices are all over the map, and quite honestly, I’m trying to find the sweet spot where I’m able to help people but I’m compensated for the liability.

I still wouldn’t touch these with a forty foot pole and gloves. I was able to (sneakily) hop onto the Zoom call regarding these and our owner asked one simple question:
“If a commercial store is renting a space and has rights to the basement, then technically it is not common space and it is their space; do we need to inspect those areas. Especially if the contract is written where the utilities and equipment are the responsibility of the renter and the boiler room is there space”
“Common space cannot be occupied by a renting party; so it would in theory need to be inspected but cannot be due to personal rights”
….that was the exchange.
I know one company who is making a killing doing these at a decent price point but I know one of the kids (Journeyman) doing the inspections and he is pretty much all ready and set to leave the city and never look back when something goes wrong….since he is just as responsible as the company.

I have a plumber coming out for the inspection that is the only one I’ve spoken to that’s accurately described what the law requires in terms of access. My neighbor has dealt with this company in the past and had good experiences, so I’m hopeful this gets it done. But does a fee of just over $700 seem right? I feel like the city created a great way for plumbers to make some money.

burpgun, it’s an untried system and while some plumbers are most definitely getting weird with it, it’s also been presented to us in the most confusing and contradictory ways possible. I have all the stuff to do the inspections and I know one thing for sure: I don’t have to go into the living spaces with the inspection. It’s a test around the point of entry, meter, and downstream piping as far as there is access. Basta.

Of course the city is going to fine owners any chance it gets, especially in today’s climate. They already decided against any extension prob cause they’re salivating at all the possible fines
Despite the company I used getting maligned here for no reason, they did the job with zero issues and they know what the city is requiring or not.

I’m really cranked up about this right now. I’m trying to find a plumber to do this inspection. I have read the city FAQ and have even contacted the DoB to make sure I have the latest info. Every plumber I have spoken with is telling me they need full access to all parts of the building, stuff that’s completely at odds with what the city says. My read on this is that it’s classic NYC: City institutes a rule for a good reason. But it creates a system where plumbers, the ones willing to do the work, use it as an opportunity to shake down owners. I was connected with a plumber company on a good recommendation and they were, at least so, the most misleading about what needed to happen. They were claiming that the needed to go in all units, inspect all gas fixtures and connections. As I read it, the law does not require access to tenant spaces. Given how many issues people are having, I’m wondering how the penalty phase is going to go. Is the city really going to drop $10K fines on folks who are trying to get this done during a health pandemic?

definitely not nuts Master Plvmber. i think we can all recognize why it is happening but based on the situation you laid out it might have been better to do this the way FDNY handles inspections – you pay FDNY an annual fee and they conduct an inspection to verify compliance, then issue a certificate. If it was set up that way through DOB you wouldn’t have the shadiness. I’m sure that DOB wants it done this way for a number of reasons (all costs and liability borne by building owners and plumbers) but it’s all so ripe for bad behavior this way.

This whole thing is so remarkably sketchy it’s frightening. I have the Gas Operator Qualification and the more I know about it, the less I want any part of it. Look at the companies doing this. “KeepMyGas.nyc”? The licensee on this company has his license on two other plumbing businesses. I got the list of participating contractors sent to me and it reads like a 1980’s Yellow Pages. A bunch of contrived names, most of them starting with “A” or “AA”… I noticed several that seem to have been formed expressly to perform LL152 inspections while limiting their liability and insulating their real businesses from potential DOB/legal fallout. This is inviting some serious fly-by-night behavior. A plumber is now newly empowered to shut the gas to your building while charging a fee to perform his own inspection. Seriously? And if he deems your gas piping unsafe, he/she gives you a proposal on the spot to perform the repairs….or we get to shut your gas, take your inspection fee…and walk away? What???
Am I nuts?

FYI – if you DON’T have gas lines in your building you have to get someone to inspect to verify that, but that person cannot actually be a licensed plumber. We had an architect do it but I think mechanical engineer can do it as well.

I disagree there. As it stands currently, Utility Company responsibility ends with the Service Valve. Same reason that the Utility Company is not responsible for the cost of repairing a Gas Line after the Service Valve they should not be responsible for the condition of it either; it would not be logical.
The part I do not understand is the insane liability it puts on the Plumber Inspecting it based on the current laws. It is not a simple Leak v No Leak; it is an inspection of constantly changing, and sometimes grey, Gas Code as well as completely grey Corrosion. If it was more clearly defined I would understand but it is too ambiguous to put my personal name on it.

I can do these inspections myself and yet will likely hire someone else to do our facility because I still do not trust any of it.
