We live in a legal 2 family townhouse on the Upper West Side. I got a mailer in our door stating we needed to comply with LL152. Does anyone know if this is the case? Thanks very much

This is making me crazy—R3 buildings are 2 family, but ours is, I think, considered B1-2 family, which seemingly means we’ll need to get an LL 152 inspection? I haven’t received any notification from any source. We did get a utility inspection but that’s not the same thing. I am not sure how to move on this.

R-3 is an occupancy classification versus B1 is a building classification. R-3 occupancy is defined as buildings that do not contain more than two dwelling units, as set forth in Chapter 3, Section 310.1.3.

It seems quite easy to confuse Occupancy Classification R-3 (two family) with Building Classification R3 (which is condos). And just to be thorough, these have nothing to do with zoning classifications.

For example, my building is a “B1 – 2 FAMILY DWELLING” on DOB BIS, my Occupancy Class is “R-3” and my Zoning is R5B.

I’m still a bit confused. The company that did our inspection (JTG master plumbing) is not doing the recommended work, they referred us to another company. One company came in and said “you don’t need to do this you’re a two family”.. I asked JTG and their response was ” according to the DOB your property is classified as R)-condominium)”

We had another company (Nationwide plumbers)come in to see the work. To seal one intake pipe and add a bunch of clevis hangers is going to cost us over 3k. Really appreciate any thoughts on this

You may want to take a look at the DOB records for your building directly, which you can do on the BIS site http://a810-bisweb.nyc.gov/bisweb/bispi00.jsp
There you can see what the certificate of occupancy says (if there is one listed). You’ll also see the department of finance classification, which is a different thing.
Note that we’ve gotten mailers/solicitations from companies offering to do LL152 inspections even though we’re occupancy classification R-3 and therefore exempt–so I wouldn’t trust anything in a mailer. Especially since you can verify it yourself.

This thread is a microcosm for everything wrong with NYC building codes and the DOB. I know I’m preaching to the choir but yeesh. Dork’s assessment does seem to be correct that BUILDING class (Property Shark link) and OCCUPANCY class (in the building code) are two different things that are easily confused, especially because they have similar letter-number codes. So of course the city ignores that fact and provides no detail on how to know that designation in explaining the law while threatening big fines for non-compliance. What a shock that unscrupulous pluming companies are sending out notices taking advantage of the confusion.

If you own a single-family or two-family building (that is not a condo), AFAIK you do not need one of these inspections. 3d, be very careful about shutting down any gas pipes (if that is what you mean by sealing an intake pipe). In townhouses, the gas for light fixtures is mixed with the gas for stoves.
