Can someone do an inspection of 2nd story deck (rear), and provide a “sign-off” letter stating that it is not a problem?
My bank is asking me to provide “Certificate of Occupancy / Certificate of Completion / Sign-off for the 2nd story deck”.
This deck showed up on the LAND SURVEY, and they said it should also be on the Certificate of Occupancy. When I looked up CofO, it appears to be an original document from 1899. While the deck appears to be perhaps from 1970’s.
Does a deck normally appear on a CofO document?
It is solid IRON construction, and anchored to the building. Very rigid. Doesn’t move at all.
Any thoughts or ideas? Should I hire an architect to inspect & provide a letter?

Both a C of O and a C of C are issued by the department of buildings. You’ll need to hire an architect or engineer to file with the DOB to legalize the deck. Or find another bank that won’t require this.

chances are the deck was never filed with the DOB… you will have 2 choices if true… hire an architect or engineer to file at which point it will have to comply to current code and be inspected, and the C of O updated to include the newly filed deck, or you will have to remove the illegal structure (which may also need to be filed) Consult one of the architects who post regularly on the forum such as Jim Hill who are familiar with this kind of stuff

You need to deal with a Bank that knows the local market & conditions of historic houses.
On line Banks for mortgages do not work for houses that are not cookie cutters.
You certainly do not want to open a can of worms with DOB or architects looking to make a fee.

You can work with a lender that doesn’t require municipal searches on a refinance in the case of an open permit or violation. Is the loan conforming or JUMBO? If there are no violations or open permits why are they hassling you over a deck? Typically all you need is a No Survey endorsement on a refinance. Never heard of this before. Issue with a bank not knowing the market. In all likelihood the deck is all wood, right? It’ll never pass inspection. I’d second Adam Dahill as well.

Yeah, bs. Get another lender. Legalizing a deck unless you’re planning a major reno is expensive and unnecessary. I’ve financed, then refinanced twice and hate to think of the state of my house in regard to permitting, but no problems.

Hey guys,
The deck is all iron and/or steel. It’s super solid. I’m guessing built in the 70’s maybe older.
Per the bank request, it is not a *new* loan. We closed in 2013. The bank raised the issue then (because it appeared on the land survey) and we put money in escrow to assuage the problem at that time.
Now they’re asking about it again because of the escrow account.
