Here’s our situation:
My wife and I own a townhouse in Brooklyn. We run a completely legal Airbnb on the first floor that grosses about 50-55k/yr. It opens to a beautiful landscaped garden that took us over 15 years to make.

The development next door needs to construct scaffolding / shed as per DOB requirements: In front, 5′ into our property from the front to the sidewalk. Outback, they need to go 20′ deep the full width of our backyard. This will stay up into the Winter or longer.

Aside from the general inconvenience, it will adversely affect our Airbnb bookings as well as ruin the garden since the shed/roof will cover its entire footprint. The lack of light will kill much of the flora. We’ve put over 15 years of work into it. To replace it, will not be cheap.

In short, I need an attorney that specializes in these construction matters to advise on what recourse we have, how to protect ourselves and negotiate a licensing contract. I also understand recent rul ings in NYC have made it easier for plaintiff to get just compensation.

Any leads to someone would be great.

wrong. airbnb is 100% legal in 1-2 family homes that are owner occupied as a primary residence.

That’s under the state law. The City has apparently interpreted and enforced City code provisions at times to prohibit short term rentals even in 1-2 fam where the owners are not present in the unit at the time of rental. I would be cautious, not confident, of what the law is in this area or how it would be interpreted in court if City enforcement were challenged.

We are facing the same problem. Except our next door neighbor wants to go back 40’ and two story. We saw a law who suggested we get our engineer to review his plans and make sure he is complying with his plans and not impinging on our property or harming our building in any way. We also will try to get a licensing agreement but not sure if he has to give it.
