It's that time of year again...Property Tax Assessment

Yup it’s that time of year – once again we are hit over the head with ever rising property taxes. Since we live in southwest Brooklyn, our prop taxes are 3x higher than downtown/north Brooklyn, Not interested in getting into a debate on inequity of property taxes. My questions is has anyone ever successfully appealed their property taxes? Last year we appealed & were denied. I gave my neighbor the comps I used & his market value was reduced by $300,000.

We were pleasantly surprised to find our assessed value went down this year. (Perhaps because of Covid? Not sure.) Before it was much too high and appeared pegged to irrelevant sales of flipped brownstones, even though we are in a dilapidated wood row that hasn’t seen a sale in more than a decade. Now the assessed value is much closer to what it might actually sell for if it were on the market, so I am not going to contest it.

two years ago i started appealing my market value when i noticed it was set at 2x what comparable houses were selling for. i wanted to pre-empt any shenanigans when/if the city decides to reform the RE tax regs and market value perhaps becomes more relevant. over two years i’ve managed to reduce my market value by 10% which means it’s still wildly inflated and nowhere near where any house in my vicinity has sold. at this point i just pull the comps every year and use the online system to appeal. i don’t think anyone really looks at the data bc they’d see that there are actually no sales even in the same price context as my house.

Please pay attention to what Oliver said. The mkt value has no bearing. It is almost a waste of time to contest the market value. I put in a lot of work to get it reduced and it had no effect. I don’t have an answer for you on what works as no one seems to know and I am still searching for the answer 🙁

the key thing to remember is that market value has no bearing on your taxes. just the assessed value or “effective market value” both of which have increases that are capped by law and not impacted by comparable sales in your neighborhood.

Can anyone advise me on how to find comparables? My mom would like to challenge the market value because it seems to be based on sales of all the renovated houses around us and not reflective of her park slope limestone that has had nothing more than minor improvements in 40 years of ownership, unfinished basement, needing a lot of investment from a future owner. I am not certain she will qualify for SCHE but she has been rejected so far because they assess tax records from before she was widowed. Thank you!

I am so sorry Augustiner. I was initially confused by the whole process. So I kept appealing to DOF without appealing to the Tax Commission which was useless. My Tax C appeal from last year is also pending. A lot of lawyers don’t want to touch as either they specialize only in commercial or they think the assessed values are low that nothing will change – i.e they don’t want to spend effort unless it’s based on what they know. The outreach events are all bogus. I still haven’t learned anything. All I know is any new permit will trigger an increase so if you are repairing any contractor mess, you’ll be paying again and paying more tax. Lose-Lose 🙁

I’ve tried for 3 years with no effect
Last year I hired a lawyer, the appeal is still pending. I‘d be surprised if anything happens.

Forget the seminars and the ‘homeowner outreach events’. They don’t address or solve systemic issues. The first question is always ‘are you in danger of losing your home’ and as long as the answer is no you won’t get anyone’s attention.

I’ve appealed the market value but as oliver mentioned has zero effect on taxes. The process of applying to the DOF and Tax commission separately is confusing and challenging. They will always argue that you aren’t paying what you should be in NY even if you pay more than other comparables in the neighborhood. It’s almost always a no-win situation.

The City runs seminars on how to marshal your argument. I found it helpful & got the changes I wanted. Look on the City website to find a seminar near you. Not sure how it’ll work w/ Covid restrictions but when I went you actually talked w/ people from DoF.

are you appealing the market value or the assessed/ effective market value? the assessed value increases are capped and almost impossible to appeal i’ve found (and probably below the true market value for most people in older houses.) i’ve appealed the market value (which doesn’t factor into the taxes you pay because of the aforementioned caps) and been successful using comps but i only do this because it bothers me to see the city think my market value at 3x what houses around me are actually selling for.
