I am in the process of buying a brownstone in Bed Stuy. I know that certain things were done without a BOD approval and i don’t want to be in a situation that I have to incur unpredictable costs. For example, I know that the back deck wasn’t done properly. WHEN i do renovations to the house, is there a chance that a DOB inspector will come in and force me to change the deck, even though it wasn’t my fault that it wasn’t done up to code?

Yes. I cannot comment on the likelihood of that happening (will leave it to others), but if you are the owner of the house, then it would be your responsibility.

Most places I looked at in Bed Stuy never had permits pulled and most decks didn’t meet code. If you are going to undergo a huge permitted renovation it’ll likley be an issue as would anything else not done to code. Smaller jobs here and there? You could probably get away with no permits in most parts of Bed Stuy. Just do it all to code.

If work has been done that required permits, you could have violations. check on D.O.B., orr check with HPD downtown. Those violations will need to be cleared.

This is exactly what happened to us. We had interior work done like central air, basement finishing etc and during a DOB inspection they slapped a violation on our house because the desk wasn’t up to code (too much wood apparently). So to remove the violation and therefore to get the utilities reconnected etc we had to file remediation plans for the deck. We chose to file plans that showed the complete removal of the deck even though that is crazy and clearly not what anyone would do (the approved plans show a 4 ft drop out of our patio doors which is apparently just fine for the DOB as long as the wood is gone!). So now, 5 years later we are in a strange limbo where we have no violation on the property, we really like our current deck which was extremely well constructed (not by us) but if we ever want to sell it will be a problem because it shouldn’t be there. Also, it is really hard to get a architect / contractor to do a deck because they want to do a whole house and they won’t really be a specialist on what is allowable in a deck.

Susan at Sketch & Hammer is the one to call to remediate deck issues or design and build a new one Also, it’s not true that you can’t sell a house with a deck “because it shouldn’t be there” unless there’s a violation on it.
