Illegal Codo Renting

Not to be snarky, but why do you care? Are the renters problematic in some way? I just wonder the pros/cons about acting at all.

I have some folks in my building renting their condo out. This is against our bi-laws. What action can our condo association take? We don’t have money to sue.

Nothing without suing! The tenants are not squatters and even then, the Police will not do anything.
You need a lawyer to sue your fellow condo owner.

You have to look to your by-laws and whatever other governing documents there are for the assocation’s powers in this situation. Does it have the power to issue fines, penalties, etc.? If so, what powers does it have to enforce payment? Co-op boards typically have more power in these situations than do condo associations, given the different ownership structure. But read through by-laws carefully, perhaps in consultation with condo association’s attorney. And don;t skip steps — act exactly within what the by-laws allow the association to do. Follow all notice obligations to the letter and then some.
