I have someone constructing a huge addition with no permits next to me. They without my consent set up pump jacks and sided the addition when I was at work. Immediately upon purchasing the property evicted the original tenants and gutted the property. They also say they’re going to dig out the basement. They seem to be doing this without any concern & have told me the worst that can happen is they’ll get a $250 fine and have to stop for a few days. They constructed three floors of the addition out of wooden 2×4 and floor joists that look like 2×8 at the most ( the span is 18 feet 16 inches on center ). Is there anything besides calling 311 I can do. I know it’s not up to code and definitely a fire hazard. This has all transpired over the course of a few weeks. I called 311 and am waiting for something to happen. They’re also rewiring and plumbing the house.

A quick call to the DOB should cause a stop work order, and its a heck of a lot more than $250 in fines.

They have now started building a wooden deck on the roof. I was told by the building department that it can take between 30 and 50 days before anyone can come out. They are also building a wooden deck on the second and third floors which I know is illegal. Our neighbors on the other side are afraid they will have their house or cars vandalized. It is an insane situation.

Just call the DOB and say something including the words “unstable, foundation, underpinning, non-permitted” and allude to there being immediate danger. That will get someone out there within days, if not hours.

If you get no response from DOB, go to your local Fire House. There is normally always someone there that will listen, explain the all of it without permits and the fire hazards etc. I have often found that things start moving after a visit, not a call… a visit to the Fire House.

“Hazardous condition”: They repond quickly to that one. I think they have to within 48hrs.

Try calling “Help Me, Howard” or a similar TV news feature on one of the other local stations. You’d be surprised how quickly the city can respond when there is some negative media coverage.

I never trusted the DoB. There is sufficient evidence they are an organized criminal conspiracy. Approach them with that attitude. Involve your NYC Council Member, anyone who will answer your call. Keep complaining. You have a lot to lose. Digging below the party walls can undermine your house. It must be monitored by DoB. Them saying they can’t get out to it for more than a month is very suspect. By then illegal work will be covered over and can’t be reversed.

DoB will stop by when nobody’s home and mark the case resolved. If you feel any vibrations at all, call 911 and tell them. We lived next door to this for a year and they nearly tore our building down in the process. The only resolution we got was when we called the cops. 311 and DoB were utterly useless.

The DoB will place markers on your facade to track any subsidence or slippage in your structure if the undermining of the party walls(both ends) occurs. You must be aggressive. Alert your Member of the NYC Council and the Community Board. Wake them up. They will follow up with requests to DoB, or they should. Alert neighbors. They have a lot to lose too.

I wanted to give an update on what has been occurring concerning the illegal construction that has been and continues to be going on next door to my home. The DOB has issued a stop work order. The construction continues. They have begun digging out the basement and have installed new gas pipes. They continue to work without any apparent concern. If you look at the DOB website you can see any complaints that come in regarding a particular street address. You can determine the severity of a complaint and based upon this take the next day off or simply not answer the door if the DOB shows up and the complaint will be closed. Any construction that is done no matter how dangerous or below code standards will remain. It will be up to you as the homeowner to sue the builder ( a corporation that was set up for the purpose of building this one building ) to take down the illegal ( in my case four story addition ). Any damage that occurs to your building will also be your burden to deal with. The take away from this experience is that anyone can build whatever they w ant, be it a fire trap, built far below code and
there really isn’t anything you or the city can do to prevent it. The amount of stress and grief that goes into dealing with this is incredible.
