Freezer in Cellar?

Bob, the cellar work is done, but the other floors are not so it’s a bit of mess upstairs.

Getting conflicting info here, but is it legal to keep a freezer chest in your brownstone cellar?

We’ve been told by one GC that we won’t pass DOB inspection with it in place.

I’m pretty sure the appliance is fine, but is he worried about where it’s going? Would it block something the inspectors need to see?

I’ve asked again and he tells me that when the inspector sees a “kitchen” appliance in the cellar they will automatically assume that you are going to create an illegal dwelling, and they will not pass you. He states that the cellar is for storage only, to which I countered that so is a freezer locker: storage of food. I know this is solved by putting it down there after, but we wanted to get a head start on freezing some things prior to the inspection, but necessity may dictate otherwise at this point.

I would be surprised if an inspector saw a chest freezer as evidence of a kitchen. Perhaps a refrigerator…but even that seems like a stretch if there is no other evidence of intent to install a kitchen.

If you want to freeze some food in advance why not temporarily plug the freezer down n upstairs?
