We’re looking to purchase a property that has a FioS pole in the backyard.
1. Does anyone know if Verizon makes home owners sign any kind of agreement forcing them to allow entry onto their property?
2. Does this agreement come grandfathered in to the new owner?
3. Is there any negotiation to make them pay “rent” or for free FioS service in our case where we are purchasing a house but the agreement was made with the previous owner who currently does not receive any benefits from hosting the pole?

I hope you’re not on the one of the Lefferts Manor blocks that was never wired for cable where the recent installation of FiOS poles, that FINALLY allowed for real high speed internet, took literally years of negotiations. Any interference with that service would not earn a newcomer popularity with his/her neighbors. OTOH I can’t imagine anyone being concerned if you got some concession from Verizon.

we purchased a house with a pole in the backyard… some Verizon wires, some TWC wires. there was a provision in our deed providing an easement for the pole. when we first moved in we tried to get the pole removed and have the wires buried. Verizon was ultimately prepared to do this but we decided against it since digging up our yard would have been more invasive. we’ve only had TWC/Verizon come by once or twice in five years to access the pole. not a huge inconvenience.

Thanks for the replies. Oliver_nyc was it tough to get them to agree to get the pole removed and the wires buried? That’s something we would be up for as we may already be digging up the yard when we renovate. Were you able to get any concessions for allowing them to continue using the pole (i.e., free service or anyting like that)? I’d appreciate letting me know how you managed that situation.

actually, i stand corrected after speaking with my wife – they agreed to *move* the pole not remove it. our pole is in the middle of back of the yard and they proposed moving it to the side and also shortening it. the most difficult part was getting to the right person from verizon. my wife spent a few days chasing them and ended up in their “engineering” department who finally sent someone out (i checked to see if i still have the phone number, i’m sorry i don’t) . even after a few visits things stalled until we chased them again. probably took 3-4 months until we finally had a guy here who said he’d be able to put in an order to move it. at that point we’d already decided to not move forward. we never actually had a discussion about getting free service – largely because we don’t even have verizon wires coming into our home (we never installed a land line after the developer of our house didn’t run telephone cables into the house.) it’s certainly worth a shot but i’m not sure if the official “easement” in the deed allows them to keep the pole without any concessions. i f i recall, our easement was basically a 2-3 ft wide strip running the length of our yard right at the back. after five years we’ve kind of embraced the pole and actually use it to run string lights across our yard. making lemonade i guess…

Just be glad you’ve got internet right there so if you have problems, it’s easy for them to access the pole. We’ve got a utility pole with a couple of services and have been asked for access maybe once in 6 years. I think they rarely need to get to it these days and if they do, they bring ladders to get over fences. We get no benefits from it the companies.
