Electric scooter in manhattan rental
I own a rental condo and the potential tenant wants to bring an e-scooter in the unit. The board forbids all e-bikes/ e-scooters in the building. He agreed to drop the issue, but I suspect he’s just going to ignore the rules. It’s a high end scooter so I’m not really afraid of fire risk, but the whole situation doesn’t sit well with me. I’m not sure how insurance will payout in the event of a fire. Any advice/input?

When you own property you have a risk of liability which is difficult to completely eliminate. In this situation, the fact that you know about the scooter, and that it is a violation of the policy could be used against you if there were a fire or other incident. Among the things you could is require renters insurance that names you and perhaps the condo as an additional insured where the tenant is liable for damages. Also you could try to require the tenant to indemnify for any damages caused by his or her negligence, if this is enforceable in a nyc condo lease which I do not know. You could also put the apartment into an LLC if you can work that out with your mortgage holder, which would limit your liability to the value of the apt.
The reality is that large landlords have insurance for these situations, while small landlords tend to fly under the radar, owning limited assets, or accepting the risks. You could talk to your insurance company about it, but I’d be more general. If you discuss a specific situation, it might lead them to increase you premiums, or canceling your policy. If you have significant assets, and don’t want to deal with this, you may not want to be a landlord in NYC.

I’d add a rider to the lease to make things explicit. That will give you an opportunity to discuss again the prohibition. Or choose another tenant; this person seems dodgy. Saying this as a two e-bike household (kid transport).
