Digging into basement

I’m currently looking to purchase a property in East New York. It is my understand that earlier this year the DOB passed a program allowing basements in East New York to be legalized as long as there are 2 means of egress and height meets 7’5 ft. This basement is currently at 6’5 feet from the bottom of ceiling joists to the current concrete slab meaning I only need to dig out another 1’5-2 ft to be legal. The basement is listed as above grade. Currently there is no C of O on the property and it is classified as a One family. Zoning does permit a conversion.

I’ve spoken to an architect whom is VERY insistent that I will need to underpin. I’ve also spoken to NUMEROUS (over 7) contractors that say the architect is wrong as he hasn’t even seen how far down the foundation goes. They are suggesting to make about 4-5 test holes so they can see where the foundation ends. The contractors say if there is enough space to excavate without underpinning, the previous slab can be removed along with dirt and a new slab can be placed making the new ceiling height 7’5-8 ft. Is anyone a ble to tell me if this is correct?

Another issue is I would like to create another means of egress from the basement to the street in front of the house. I do know that I will need a permit for both general contracting and plumbing but will I be required to change the C of O? Or can I just keep this as Alt 2 permit leaving the property as a 1 family?

I’m looking for advice as well as direction on this matter. Any advice will be greatly appreciated!

Yikes, booisgolden, talk about a catch-22! Also, curious — HPD is involved? These units would be rent regulated, even though they are in two-family houses, which are not rent regulated? Thank you!

Hi Cate! It IS much less than they have made it out to be — I don’t know why anyone who is already illegally renting a basement apt (which I think is the target audience) would go thru the process — surely the City will not approve the existing apt as is, which will incur costs, then afterwards the LL is extremely restricted by HPD on how much rent they can charge (which would surely be less than what they are already charging). AND they have to answer to HPD after that as well — for a two fam!

We only wanted to do it because we aren’t renting out our basement, and would have liked to be able to say we are legit two fam when we sell, to increase our property value. Or, actually get a tenant. But also, the only people who really have the money in our area to do the renos of the type we’d need to do are people who are income limited out from the program.

So the people who have the money to do it were incomed out, and the people who REALLY need the help (the majority in our nabe, and target audience) still can’t afford to do it legally, or the incentive is remov ed. It’s like a circular firing squad.

I got the idea not many people were signing up for it — until we finally picked up the phone to tell them we didn’t qualify they basically called or texted us several times a week.

booisgolden, I read the law the City Council passed about the basement conversion. It seems to be much less than they have made it out to be. It appears to simply be a program offering low-cost loans to people who want to legally convert from a one-family to a two-family. What do you think?

Bear in mind that there are also sections of the Building Code entitling adjacent property owners, in cases of underpinning or other encroachment, to party wall license agreements. So you ‘d have to negotiate with your neighbors, typically pay their legal fees and expenses for the attorney and engineer representing each, permit them to review your plans, deal with vibration monitors and crack gauges on their properties at your expense, and make sure that you or your contractor carry job-specific insurance, from which activities such as earth movement, or anything else included in the job, cannot be excluded. Your neighbors’ attorneys will review your insurance policy in the course of negotiating the license agreements, and won’t agree to sign anything unless those policies are adequate. It’s impossible for a homeowner (i.e., your adjacent neighbors) to get earth movement insurance through their own homeowners’ policies. The neighbors’ engineers will also do pre-construction surveys to determine the precise condition of your neighbors’ properties before the job starts , so any damage caused by your project can be identified as such. PS: I speak from experience; my next door neighbor did an unpermitted basement excavation down to the bottom of the foundations, and as soon as it was reported, the DOB shut him down and slapped him with so many Stop Work Orders the project bit the dust and the building remains unoccupied years later. This is nothing to fool around with; he could have pulled down three brownstones. Years ago on McDonough St in Bed Stuy, there was a similar situation that resulted in a collapse of the center building, except for the facade, and the evacuation of the buildings on either side.

The only way to do this is legally, and it isn’t cheap. And if you try it illegally, chances are you’ll wind up in the same situation as the above-mentioned next door neighbor.

I’ve written about it many times, but we did a version of this and what you’re proposing is a big deal in that 1) if you do it wrong disaster can happen (building collapse at worst, cracked/shifted walls) 2) changing your house CO takes a year or so and 3) it’s all very expensive. If you have lots of cash great. But in order to do the work you propose you need engineering drawings, a whole raft of special inspections and DO NOT attempt all this without doing it by the book. You could lose everything, your homeowners insurance won’t cover you if you do illegal work yada yada yada.
We did by the book and the process is doing borings to test for foundation depth but also soil composition. And yeah to gain a foot means digging down ~2 feet as you need 4″ slab, plus insulation and 4-6″ of gravel and all that. That could put you close to the depth of your foundation, which is often a rubble wall.

FWIW, my home doesn’t even have a footing. I know most do, but not all. agree with resident2. don’t mess around with major structural parts without the input of someone who is professional AND has something to lose (licence, integrity, reputation, etc.).

In order to have an extra ceiling height of 1.5 – 2 feet higher you will need to dig down at least 3 ft to get the right damp course, slab foundations etc. Any contractor that is telling you that you will not need to underpin does not have any experience with the typical houses in Brooklyn; the footings are typically about 1.5 -2 feet.
If you are creating a 2 family situation you will need a complete new C of O.
Get a second opinion from an architect , but it sounds like your contractors just want to get a job & some money from you… do the borrings to test how far down the footings are, they will be as I said 1.5 -2.00 feet down if that.

Before you go and get all excited about the basement program, make sure you read the fine print. There’s LOTS of it and a number of restrictions.

We aren’t able to participate bc of the income restrictions- we are solidly middle class and earned too much to participate. We would have loved to do it!
