Contractor license has expired

Whats the best way to handle this?
Contractor license has expired, and he’s unable to renew due to financial issues.

I should add this, he probably no longer has his completion bond. But again, if he is doing what he says he will do that should not be an issue.

The city does not give a toss. The only reason they require a completion bond is to force the bonding company to go after the crooked contractors who fail to complete jobs.

what kind of contractor? if he is a GC that might mean trouble for you (a GC has to keep $25,000 in the bank). if he is a HIC in this city, you will NOT get fined if you keep using him (in other jurisdictions they will fine the homeowner AND the contractor; in NYC they can seize the contractor’s tools and vehicle but that will not happen unless you call on him which you are not going to do). I will be honest with you: if an HIC works without a license (in this city), if you do not pay the HIC, they CANNOT file a mechanic’s lien against you and CANNOT take you to court (in other words, the contractor, not you, will suffer). All the city does by licensing us is check to see we are who we say we are and fingerprint us and give us a test to be sure we know right from wrong (basically things we learned in kindergarten). Make sure he still carries insurance.

the city’s failure to enforce the laws it has in an unbiased manner is what annoys a lot of people who do business here. in short, they will penalize us if we have the money to pay fines and will ignore the people who can’t pay fines or who manage to fly under the radar somehow and it is very unfair to people who want to do the right thing. if the city made a law that penalizes both the homeowner and contractor when an unlicensed contractor is used, there would be a lot less nonsense with contractors in this city and we would keep people who are not fully committed to an vested in this industry.

in so far as OP’s contractor: if he was honest and good the day before the license expired he is going to be no less honest today.

If your contractor can’t cover the roughly $300 renewal fee or maybe there’s a problem with insurance, you should stop working with this contractor and find a new contractor. you hired a licensed contractor and this is a huge red flag. is the contractor asking for help to resolve their “financial issues” so that they can renew?
