Building has a temporary Certificate of Occupancy that expired in 2014,now what?

@JorgeF. Hi. I was trying to get a timeframe to remediate as well as possible cost and learned it shouldn’t take more than a month and less than 10k (mostly architect fees). Thank you for your valuable input.

Temp CofO needs to be renewed every 3 months. It is also easier to get than a final so there might be pending issues precluding you from getting a final CofO. DOBs website will have a required items list for your job one can check online to see if you can get a CofO or if not what is pending.

Just because the DOB website doesn’t show the permanent CofO, it doesn’t mean it isn’t there. My permanent CofO was never logged in the system, but I have it. The DofB acknowledges the sign offs were obtained and permanent was issued, but it could have gotten scanned incorrectly or just never entered…and they insist it doesn’t matter and won’t update the public system.

Check the required items list for your project to see if you have sign offs. check the job status. Hoping the DOB just forgot to put it in the system is not a solution to a problem. And is bad advice.

@JorgeF You’re right. There are still 30 missing required items & they won’t issue a renewal until resolved. Plus something about the approved drawings not matching the numbers on Schedule A. I wonder how severe and how long this will take?

The drawings and the forms have to match! That is very important. There are certain things you can let slide that is definitely not one. Call your architect they will need to do a PAA if they do not have one open all ready. Also the required items list has to be resolved 100% So you need to go item by item and track down each individual responsible and get them to resolve the open items. Your architect should be very familiar with this process. This is CofO 101.
As for the amount of time I can’t say because I do not have specifics on your project. It depends how fast your team moves on it.
Also you should renew the temp CofO I assume you are occupying a space without a CofO. That is not good. Your Temp CofO expired 2 years ago. What happened to your team. They couldn’t get a CofO in 2 years?

On a side note. I am an architect. Please be careful who you take advice from. I come to this forum to see what people’s concerns and questions are so I can get Ideas for my blog. I really see lots of really bad advice being thrown around here. Like the person who said the DOB prob ably just didn’t put the CofO in the system. Be careful about taking advice online. Also DOB hosts homeowners nights every week where you can walk in and get free advice. Take advantage of that.
Also the more someone blames things on the DOB the less you should trust them. Most job delays are caused by property owners, contractors, and architects. Not DOB. I am an architect just keeping it real.

JorgeF, if you read my reply, I wasn’t saying they should rely that their CofO was done and just not recorded. But that I had that experience and it was a possible reason. Clearly if sign offs were missing, then it is a different matter. I think it is good advice to go through a process of elimination, starting with the simplest first — which was maybe the DOB screwed up.

It is not good advice. The process of elimination with a CofO is to look at the required items list. That’s kind of the definition of a list. That’s why it exists. I do not want to argue with you. It is not good advice to say oh I just assume the DOB screwed up. There is a reason the required items list exists that is the first thing you look at when you are concerned with CofO or sign off or approval or just about everything done at DOB. Hoping the DOB screwed up is silly when there are empirical ways of checking the status of your project online. It takes 2 minutes to look this up on the DOB website. Sorry for saying you gave bad advice I could have phrased it differently.
But seriously I come to this forum to see what homeowner concerns are to help me think up topics for my blog and I constantly see people giving uninformed advice.
I mean the person who posted the question even said they had 30 items pending on the required items list. That’s not the DOB’s screw up. That’s the architect and contractors never finished the damn job.

not sure exactly what you are asking me to ballpark,
From looking at the required items list they need to do all the inspections and PASS them. Including the original applicant’s TR1 & TR8. Progress inspections and special inspections need to be done during construction and technical reports filed to confirm. All the typical paperwork due for CofO is needed and typical inspections. There is nothing unusual on your required items list. Where is your team? You hired people to do this job? Why aren’t they doing it? Did they finish the construction?
As per objections the drawings do not match the PW1A that’s a problem. The drawings the paperwork and the built condition all need to match. Which is right? is it the Schedule A or the drawings? Are either one right are both wrong? If one is wrong you will need to do a PAA (post approval amendment) to change whichever one is wrong. Make sure they all are reflecting what is actually built. And of course first verify if they actually are inconsistent with each other and with the building.
