anyone have experience with holdover vs nonpayment case?

(before i ask an attorney)
I would like to know your experience with which case type would be best for the tenants below in nyc

tenant #1 – legal unit – month to month – owes 5k

tenant #2 – not legal basement unit – month to month – owes 10k

any major difference between the two case types in terms of timeline? i just want them out.

As you cannot legaly collect rent on an illegal apartment the basement will be an Ejection proceeding in Suprem Court.
The legal apartment, if all you want is them out, it will be a holdover in L&T court. Use the back rent to limit howmuch time they can ask for. If they are up to date, they can get 6 months to vacate. But speak to L&T lawyer. Not a lawyer that does divorces, personal injury & parking tickets. A Lawyer that is in L&T court all day, every day. In the Borough of the building.
