Alt 1 Reno: do we need new CO before moving in?

We’re getting a LOT of mixed info here: rough in, gas and electric tests are all passed and we want to move in.

Some are telling us that we need the new CO before we can legally occupy the space.

Some are telling us that we can move right in since there was an existing CO prior to the reno. Their logic is that people live in homes during Alt 1’s all the time.

So which is it?!?

You cannot rely on some expediter. Mine was useless when I had some problems and I ended up sorting it myself. The only one that I trust and I couldn’t use (as my architect has his own) is William Daley. My friend works there. She’s German; very thorough so when in doubt I check with her. Re DOB, better to play it safe and get Temp C of O. Even people who work at DOB have different approaches. One will tell you you’re ok then you’ll find out later that some form needed to be filed. Now I play it safe and file every thing and always send in every supporting doc otherwise they will reject and you’ll waste more time.

The DOB & officials of any kind; even your own Architect etc will be evasive on this, because if you get hurt on the “construction site” are you going to sue them; because they said it was OK?
If you have children; I would say no. But if you are adults, you own it, you take your own responsibilities.
You definitely cannot/should not rent it and move tenants in without a C of O.

This is all helpful, but also speaks to the variety of answers one can receive when trying to get to the bottom of something DOB related! It feels as though this should be an easily answered question on the DOB website, but of course… it’s not.

Sounds like, to be safe and fully above board, we should secure a TCO, while waiting for our final CO to come through (the timing of which is another mystery of the DOB).

CarmenR: our GC tells us that people move in all the time, but that we technically run the risk of being issued a violation and vacate order (he works as someone who handles violations and says he sees this happen all the time).

vard01: we spoke to our expeditor and he assures us we can move in, but he has made a significant number of mistakes regarding code throughout the course of our project and my confidence is somewhat shaken.

We moved in when we converted our house from a 2 fam to a single fam. We had not passed any inspections yet and were still under construction (we had electric but no gas when we moved in.) Our contractor/inspectors/expeditors didnt see any issues with it (although it was a rough 5 months!)

Thanks for clarifying. I had a feeling you had changed it and that’s why people were saying you can’t move into the building. Sounds like you can get a temp C of O, however. Did you ask an expediter or call DOB? Call for n inspection from DOB and you should be able to get a temporary CO without too much trouble and can occupy while waiting for the final CO papers.
