1 Yr Later after My Neighbor Destroyed my Property No cooperation from Neighbor

On July 6, 2015 as I was out of New York I was informed that the party wall I share with my neighbor LLC had collapse from the 3 rd floor roof to the basement. As I arrived to my townhouse destroyed I started talking to lawyers in Manhattan and Brooklyn and they all advised me to work the situation with the neighbor. I called 311 DOB stopped the work on my neighbor LLC and DOB put a VACATE sign on my property. I hired a engineer and continued to work with the neighbor LLC. Found out through my engineer that my neighbor LLC had ” NO DEMO PERMIT”. So at that point I knew my neighbor LLC were not being honest and something was wrong. So I retained a lawyer after finding out false information from neighbors LLC…. During the process I had my home insurance check the damage. My home owners insurance denied coverage. They claim they ” do not cover collapse “. We started a litigation against the neighbor LLC with NO DEMO PERMIT !!
Well fast forward: I had to relocated from my Primary Home that I purchased in 2002. My homeowners Insurance has denied my coverage again af ter for the 2nd times. My neighbor LLC has dragged the litigation and have only offered to pay my Lawyer fee and fix the party wall. My lawyer has basically said we have done all we can.
Should I start a lawsuit myself at the supreme court free against the neighbor? Should I get the media involded ? If anyone can help me with any information..

I have been thinking and analyzing what you wrote and its been on my mind even before I read your input. I have gone online and I found New York Peace Institute to have a Free Mediation with my neighbor LLC. But before I meet with him “The owner of property” Not LLC I just want to make sure I have all the facts and numbers to present to him. At least if nothing gets resolved I able to see where he stands and if he’s even going to considering paying more than what was offered a while back. I am just going to run something with my lawyer. If he does not budge on paying more I think I will just start a Law Suit on my own through Supreme Court.
I hope this could resolve some or all issues.
What do you guys think?

You can certainly pursue the matter to litigation and roll the dice, but you may end up walking away with even less than you have with the settlement that’s on the table. Only you can make that decision, in consultation with your lawyer. I am sure your neighbor has his own version of the story and an impartial judge and/or jury may not see things 100% your way. It sounds like your current lawyer advised you to take the settlement offer. If you do not agree, then find another lawyer for a second opinion and then reevaluate your options.

Well, for starters, I would want to be compensated not only for legal fees and the repair, but also for the expenses relating to moving out of and back into the residence that was damaged, as well as rent and whatever other expenses incurred while living somewhere else for a year as a result of the negligence.

Also go the media route. I have ongoing litigation with the seller of my home. My lawyer and his both tell me I will win when we eventually get to court, if he doesn’t settle first, which he is resisting. If I and the court knew he had a pattern of screwing homeowners, justice would come easier to those who deserve it. Connecting the dots helps.

As a lawyer myself, if you hired a competent lawyer and he/she has come to the conclusion, after diligent efforts, that you have done all you can and should accept the deal on the table, then that is probably the best course of action. Housing problems are different than problems with other business transactions because your house is your home, and there is an emotional element, but as slopefarm says, this issue is ultimately a business issue. Evaluate all options and choose the best course of action.
